6. คณะกรรมการรับและเปิดซองประกวดราค

6. คณะกรรมการรับและเปิดซองประกวดราคา มีหน้าที่ ดังนี้
(1) รับซองประกวดราคา ลงทะเบียนรับซองไว้เป็นหลักฐาน ลงชื่อกำกับซองกับบันทึกไว้ที่หน้าซองว่าเป็นของผู้ใด
(2) ตรวจสอบหลักประกันซองร่วมกับเจ้าหน้าที่การเงินและเจ้าหน้าที่การเงินออกใบรับให้แก่ผู้ยื่นซองไว้เป็นหลักฐาน หากไม่ถูกต้อง ให้หมายเหตุในใบรับและบันทึกในรายงานด้วย กรณีหลักประกันซองเป็นหนังสือค้ำประกัน ให้ส่งสำเนาหนังสือค้ำประกันให้ธนาคาร บรรษัทเงินทุนอุตสาหกรรมแห่งประเทศไทย บริษัทเงินทุนหรือบริษัทเงินทุนหลักทรัพย์ผู้ออกหนังสือค้ำประกัน ทราบทางไปรษณีย์ลงทะเบียนตอบรับด้วย
(3) รับเอกสารหลักฐานต่างๆตามบัญชีรายการเอกสารของผู้เสนอราคาพร้อมทั้งพัสดุตัวอย่างแคตตาล็อก หรือรูปแบบ หรือรายการละเอียด (ถ้ามี) หากไม่ถูกต้องให้บันทึกในรายงานไว้ด้วย
(4) เมื่อพ้นกำหนดเวลารับซองแล้ว ห้ามรับซองประกวดราคา หรือเอกสารหลักฐานต่างๆตามเงื่อนไขที่กำหนดในเอกสารประกวดราคาอีก
(5) เปิดซองเสนอราคา และอ่านแจ้งราคาพร้อมบัญชีรายการเอกสารหลักฐานต่างๆ ของผู้เสนอราคาทุกราย โดยเผยตามเวลาและสถานที่ที่กำหนด และให้กรรมการทุกคนลงลายมือชื่อกำกับไว้ในใบเสนอราคาและเอกสารประกอบใบเสนอราคาทุกแผ่น
ในกรณีที่มีการยื่นซองข้อเสนอทางเทคนิคและข้อเสนออื่นๆ แยกจากซองข้อเสนอด้านราคาซึ่งต้องพิจารณาทางเทคนิคและอื่นๆก่อน ตามเงื่อนไขที่ได้กำหนดไว้ คณะกรรมการรับและเปิดซองประกวดราคาไม่ต้องปฏิบัติหน้าที่ตามวรรคหนึ่ง โดยให้เป็นหน้าที่ของคณะกรรมการการพิจารณาผลการประกวดราคาที่ต้องดำเนินการต่อไป
(6) ส่งมอบใบเสนอราคาทั้งหมด และเอกสารหลักฐานต่างๆพร้อมด้วยบันทึกรายงานการดำเนินการต่อคณะกรรมการพิจารณาผลการประกวดราคา ทันทีในวันเดียวกัน
(7) คณะกรรมการพิจารณาผลการประกวดราคา มีหน้าที่ ดังนี้
(1) ตรวจคุณสมบัติของผู้เสนอราคา ใบเสนอราคา เอกสารหลักฐานต่างๆ พัสดุตัวอย่าง แคตตาล็อค หรือแบบรูปและรายการละเอียด แล้วคัดเลือกผู้เสนอราคาที่ถูกต้องตามเงื่อนไขในเอกสารประกวดราคา
ในกรณีที่ผู้เสนอราคารายใดเสนอรายละเอียดแตกต่างไปจากเงื่อนไขที่กำหนดในเอกสารประกวดราคาในส่วนที่มิใช่สาระสำคัญ และความแตกต่างนั้นไม่มีผลทำให้เกิดการได้เปรียบต่อผู้เสนอราคารายอื่นหรือเป็นการผิดพลาดเล็กน้อย ให้พิจารณาผ่อนปรนให้ผู้เข้าประกวดราคาโดยไม่ตัดผู้เข้าประกวดราคารายนั้นออกในการพิจารณา คณะกรรมการอาจสอบถามข้อเท็จจริง
(2) พิจารณาคัดเลือกสิ่งของ หรืองานจ้าง หรือคุณสมบัติของผู้เสนอราคาที่ตรวจสอบแล้วตาม (1) ซึ่งมีคุณภาพและคุณสมบัติเป็นประโยชน์ต่อทางราชการ แล้วให้ซื้อหรือจ้างจากผู้เสนอราคารายที่คัดเลือกไว้แล้ว ซึ่งเสนอราคาต่ำสุด
ในกรณีที่ผู้เสนอราคาต่ำสุดดังกล่าวไม่ยอมเข้าทำสัญญาหรือขัดข้อตกลงกับส่วนราชการในเวลาที่กำหนดตามเอกสารประกวดราคา ให้คณะกรรมการพิจารณาจากผู้เสนอราคาต่ำรายถัดไปตามลำดับ
ถ้ามีผู้เสนอราคาเท่ากันหลายราย ให้เรียกผู้เสนอราคาดังกล่าวมาขอให้เสนอราคาใหม่พร้อมกันด้วยวิธียื่นซองเสนอราคา
ถ้าปรากฏว่าราคาของผู้เสนอราคารายที่คณะกรรมการเห็นสมควรซื้อหรือจ้างสูงกว่าวงเงินที่จะซื้อหรือจ้าง ให้คณะกรรมการพิจารณาผลการประกวดราคาดำเนินการตามต่อรองราคาให้ต่ำสุดเท่าที่จะทำได้
(3) ให้คณะกรรมการรายงานผลการพิจารณา และความเห็นพร้อมด้วยเอกสารที่ได้รับไว้ทั้งหมดต่อหัวหน้าส่วนราชการ โดยเสนอผ่านหัวหน้าเจ้าหน้าที่พัสดุ
(8) เมื่อคณะกรรมการพิจารณาผลการประกวดราคา ได้พิจารณาแล้ว ปรากฏว่า มีผู้เสนอราคารายเดียวหรือมีผู้เสนอราคาหลายรายแต่ถูกต้องตามรายการละเอียดและเงื่อนไขที่กำหนดในเอกสารประกวดราคาเพียงราคาเดียวโดยปกติให้เสนอหัวหน้าส่วนราชการยกเลิกการประกวดราคาครั้งนั้น แต่ถ้าคณะกรรมการพิจารณาผลการประกวดราคาเห็นว่ามีเหตุผลสมควรที่จะดำเนินการต่อไปโดยไม่ต้องยกเลิกการประกวด ก็ให้ดำเนินการพิจารณาผลการประกวดเห็นว่ามีเหตุผลสมควรที่จะดำเนินการต่อไปโดยไม่ต้องยกเลิกการประกวด ก็ให้ดำเนินการพิจารณาคัดเลือกสิ่งของหรืองานจ้างหรือคุณสมบัติของผู้เสนอราคาที่คัดเลือกไว้แล้ว ซึ่งเสนอราคาต่ำสุด
(9) ในกรณีผู้เสนอราคา หรือมีแต่ไม่ถูกต้องตามรายละเอียด และเงื่อนไขที่กำหนด ให้เสนอหัวหน้าส่วนราชการยกเลิกการประกวดราคาครั้งนั้น เพื่อดำเนินการประกวดราคาใหม่ หากหัวหน้าส่วนราชการเห็นว่า การประกวดราคาใหม่จะไม่ได้ผลดี จะสั่งให้ดำเนินการซื้อหรือจ้างโดยวิธีพิเศษก็ได้
(10) หลังจากการประกวดราคาแล้วแต่ยังไม่ได้ทำสัญญาหรือตกลงซื้อ หรือจ้างกับผู้เสนอราคารายใด ถ้ามีความจำเป็นเพื่อประโยชน์ของทางราชการเป็นสาเหตุให้ต้องเลี่ยนแปลงสาระสำคัญในรายการละเอียด หรือเงื่อนไขที่กำหนดไว้ในเอกสารประกวดราคาซึ่งทำให้เกิดการได้เปรียบระหว่างผู้เข้าเสนอราคาด้วยกัน ให้หัวหน้าส่วนราชการพิจารณายกเลิกการประกวดราคาครั้งนั้น
(11) การซื้อหรือการจ้างที่มีลักษณะจำเป็นต้องคำนึงเทคโนโลยีของพัสดุและหรือข้อกำหนดคุณสมบัติของผู้เข้าเสนอราคา ซึ่งอาจจะมีข้อเสนอที่ไม่อยู่ในฐานะเดียวกันเป็นต้นเหตุให้มีปัญหาในการพิจารณาตัดสินและเพื่อขจัดปัญหาดังกล่าวจำเป็นต้องมีการปรับปรุงข้อเสนอให้ครบถ้วนและเป็นไปตามความต้องการก่อนพิจารณาด้านราคา หรือการซื้อหรือการจ้างแบบเหมารวม (Lump Sum Turnkey) ที่คณะรัฐมนตรีได้อนุมัติให้ดำเนินการให้ถือปฏิบัติเช่นเดียวกับการประกวดราคาทั่วไป เว้นแต่การกำหนดให้ผู้เข้าเสนอราคายื่นซองประกวดราคาโดยแยกเป็น
(1) ซองข้อเสนอด้านเทคนิคและข้อเสนออื่นๆ
(2) ซองขอเสนอด้านราคา
(3) ซองข้อเสนอทางการเงิน
ทั้งนี้ ให้กำหนดวิธีการ ขั้นตอน และหลักเกณฑ์การพิจารณาไว้เป็นเงื่อนไขในเอกสารประกวดราคาด้วย
(12) ให้คณะกรรมการพิจารณาผลการประกวดราคาทำหน้าที่เปิดซองข้อเสนอด้านเทคนิคของผู้เสนอราคาแทนคณะกรรมการการรับและเปิดซองประกวดราคา และพิจารณาผลการประกวดราคา โดยถือปฏิบัติในส่วนที่ไม่ขัดกับการดำเนินการดังต่อไปนี้
