หลักนิติธรรมอิสลาม หมายถึง สิ่งซึ่ง

หลักนิติธรรมอิสลาม หมายถึง สิ่งซึ่งพระองค์อัลลอฮฺ ได้ทรงบัญญัติสิ่งนั้นเอาไว้แก่มวลบ่าวของพระองค์จากบรรดาหลักการทั้งหลาย ไม่ว่าจะเป็นบรรดาหลักการที่เกี่ยวเนื่องกับหลักการยึดมั่น หรือหลักจริยธรรม หรือการจัดระเบียบสิ่งที่ออกมาจากมนุษย์ทั้งวจีกรรม, กายกรรมและการทำธุรกรรมทั้งหลาย
กฎหมายอิสลาม หมายถึง ประมวลหลักการปฏิบัติต่าง ๆ ตามศาสนบัญญัติซึ่งจัดระเบียบพฤติกรรม วจีกรรมและการทำธุรกรรมทั้งหลายของบรรดาผู้ที่เข้าอยู่ในเกณฑ์บังคับของศาสนา โดยมีที่มาจากคัมภีร์อัลกุรฺอานและสุนนะฮฺตลอดจนบรรดาหลักฐานทางศาสนบัญญัติอื่น ๆ
นัยของหลักนิติธรรมอิสลามจึงมีความครอบคลุมและกว้างกว่านัยของกฎหมายอิสลาม เนื่องจากหลักนิติธรรมอิสลามจะประมวลถึงหลักการยึดมั่น และหลักจริยธรรม ตลอดจนประมวลกฎหมายอิสลามเอาไว้ด้วย จึงกล่าวได้ว่า กฎหมายอิสลามเป็นส่วนหนึ่งของหลักนิติธรรมอิสลามโดยรวม
กฎหมายอิสลาม แบ่งออกเป็น 2 หมวดใหญ่ ๆ คือ
1. หมวดการประกอบศาสนกิจ (อัลอิบาดาตฺ) ซึ่งจะกล่าวถึงบรรดาหลักการเฉพาะที่ว่าด้วยความสัมพันธ์ของปัจเจกบุคคลกับพระองค์อัลลอฮฺ อาทิเช่น การละหมาด, การจ่ายซะกาต, การถือศีลอด และการประกอบพิธีฮัจญ์ เป็นต้น
2. หมวดปฏิสัมพันธ์ (อัลมุอามะลาตฺ) อันหมายถึงบรรดาหลักการเฉพาะที่ว่าด้วยความสัมพันธ์ระหว่างมนุษย์ด้วยกัน อาทิเช่น การซื้อขาย, การทำธุรกรรมในรูปแบบต่าง ๆ การสมรส และการตัดสินข้อพิพาท เป็นต้น
ในส่วนของนักวิชาการสังกัดมัซฮับอัชชาฟิอีย์ ได้แบ่งหมวดของกฎหมายอิสลามออกเป็น 4 หมวด คือ
หมวดการประกอบศาสนกิจ
หมวดปฏิสัมพันธ์
หมวดลักษณะอาญา
หมวดการสมรส หรือกฎหมายครอบครัว
* จากสิ่งที่กล่าวมาข้างต้น ย่อมเป็นที่ประจักษ์ว่า ประเภทหมวดของกฎหมายอิสลามมีความครอบคลุมถึงเรื่องราวทางศาสนาและทางโลก ในขณะที่หลักนิติธรรมอิสลามตั้งอยู่บนหลักพื้นฐานของการจัดระเบียบที่ครอบคลุมกิจกรรมทุกมิติของมนุษย์ ไม่ว่าจะเป็นมิติทางจิตวิญญาณ, จริยธรรม และวัตถุ
ความสำคัญของกฎหมายอิสลาม
กฎหมายอิสลามมีอัล-กุรอานและอัล-หะดีษเป็นแม่บทที่สมบูรณ์ครบถ้วน และเป็นธรรมนูญในการดำเนินชีวิตของมุสลิม โดยประมวลกฎหมายอิสลามได้กำหนดภารกิจของมนุษย์ที่มีต่อพระองค์อัลลอฮฺ หน้าที่ต่อตัวเองและหน้าที่ต่อเพื่อนมนุษย์ด้วยกัน และมีเป้าหมายในการพิทักษ์คุ้มครองสิ่งสำคัญ 5 ประการ คือ (1) ศาสนา (2) ชีวิต (3) สติปัญญา (4) เชื้อสายโลหิต และ (5) ทรัพย์สิน
หากเราพิจารณากฎหมายอิสลามอย่างกว้าง ๆ ในแง่ความสำคัญแล้วพอจะกล่าวได้ดังนี้ คือ
(1) กฎหมายอิสลามเป็นธรรมนูญแห่งชีวิตที่มุสลิมทุกคนจำต้องยึดถือปฏิบัติโดยเคร่งครัด ทั้งนี้การปฏิบัติตามกฎหมายอิสลามมีผลทำให้ปัจเจกบุคคลมีความเป็นปกติสุขและทำให้สังคมโดยรวมเกิดความสันติสุข
(2) กฎหมายอิสลามได้กำหนดสิทธิและหน้าที่ส่วนบุคคลและสิทธิประโยชน์ส่วนรวมเอาไว้อย่างมีดุลยภาพและครบถ้วน ชัดเจน มีความเป็นธรรมและสมเหตุสมผล ยืดหยุ่นและเหมาะสมกับทุกยุคทุกสมัย
(3) กฎหมายอิสลามได้จัดระเบียบสังคมทุกระดับโดยเป็นไปตามครรลองที่ถูกต้องและเป็นธรรมทั้งในด้านสังคม, เศรษฐกิจ, การเมือง และการปกครองและมุ่งพิทักษ์รักษาผลประโยชน์ของทุกฝ่าย
