เรื่อง ร้องเรียน ห้างหุ้นส่วนจำกัด ส.อำนวยนครพนมวิศวกรรม กับพวกรวม 4 คน

ข้าพเจ้านายโอลอฟ ออลเล่ ฮาเกอร์ (Lars olof Olle Harger) อายุ 49 ปี อีเมล์ติดต่อ[e-mail] สัญชาติสวีเดน ถือหนังสือเดินทางสัญชาติ สวีเดน เลขที่ 81755543 ที่อยู่ที่สามารถ ติดต่อได้ 731/44-47 ยานนาวา บางคอแหลม กรุงเทพมหานคร ขอแจ้งข้อร้อนเรียนต่อ เลขาธิการคณะกรรมการสำนักงาน ป.ป.ง. ถึงเรื่องที่เกิดแก่ข้าพเจ้าและเพื่อนของข้าพเจ้าจากการกระทำของ ห้างหุ้นส่วนจำกัด ส.อำนวยนครพนมวิศวกรรม โดยเมื่อประมาณวันที่ 26 ตุลาคม 2556 ข้าพเจ้าได้เข้าทำสัญญาร่วมทุนกับ ห้างหุ้นส่วนจำกัด ส.อำนวยนครพนมวิศวกรรมโดยนายกิตติศักดิ์ กวานเหียน ตั้งอยู่ เลขที่ 52/77 ซอยสามัคคีสุขสันต์ ถนนนครพนม-ท่าอุเทน ตำบลหนองแสง อำเภอเมือง จังหวัดนครพนม โดยข้าพเจ้าได้ให้หจก.ดังกล่าวกู้ยืมเงินไปจำนวนประมาณห้าล้านบาท โดยทำเป็นสัญญาร่วมทุนและสัญญาฉบับแรกนั้นเกิดข้อพิพาทกันทำให้ข้าพเจ้าใช้สิทธิเรียกร้องทางศาลโดยการฟ้องหจกและจำเลยร่วมทั้งหมดเป็นคดีอาญาทั้งนี้ทั้งนั้นทางฝ่ายหจก.และจำเลยร่วมก็กลั่นแกล้งข้าพเจ้าโดยฟ้องข้าพเจ้าเป็นคดีอาญาเช่นกัน เนื่องด้วยข้าพเจ้าไม่เข้าใจภาษาไทยประกอบกับข้าพเจ้าไม่เข้าใจในกฎหมายไทยจึงกลัวหากฟ้องร้องคดีอาญาแล้วจะทำให้ข้าพเจ้าติดคุก ข้าพเจ้าจึงยอมยุติคดีอาญาแล้วเข้าทำหนังสือสัญญาร่วมทุนกันใหม่ในวันที่ 15 กรกฎาคม 2556 โดยระบุให้ หจก ดังกล่าว ผ่อนชำระต้นเงินพร้อมดอกเบี้ยที่ได้กู้ยืมไปจากข้าพเจ้ารวมต้นเงินพร้อมดอกเบี้ย ณ วันที่ 15 กรกฎาคม 2556 เป็นเงินจำนวน 5,796,100 บาท พร้อมดอกเบี้ยอัตราร้อยละ 15 ต่อปีโดยจะชำระเงินให้แก่ข้าพเจ้าไม่น้อยกว่าเดือนละ 50,000 บาท รายละเอียดปรากฎตามเอกสารแนบท้าย ต่อมาภายหลังหจกก็มิได้ผ่อนชำระแก่ข้าพอีกเลยทำให้ข้าพเจ้าต้องจ้างทนายดำเนินคดีทางแพ่งต่อ หจก พร้อมพวกดังกล่าว และได้คำพิพากษาศาลตามยอม หมายเลขคดีดำทื่ 1475/2556 แดงที่ 1058/2557 ศาลจังหวัดนครพนม
ภายหลังจากได้คำพิพากษาศาลทางหจกได้ผ่อนชำระให้ข้าพเจ้ามาจำนวน 6 งวด งวดละ 1 แสนบาท รวมเป็นเงิน 600,000 บาทถ้วนโดยชำระงวดสุดท้ายเมื่อวันที่ 2 เดือน มีนาคม 2558 รายละเอียดปรากฎตามตารางการผ่อนชำระ หลังจากที่ หจก มิได้ชำระหนี้แก่ข้าพเจ้าอีกข้าพเจ้าได้แจ้งแก่ทนายความของข้าพเจ้าทราบ ทนายความของข้าพเจ้าได้ทำการสืบทรัพย์ เพื่อจะบังคับคดีแก่ หจก.กับพวก แต่ปรากฎว่าทนายความแจ้งแก่ข้าพเจ้าว่าจำเลยทั้งหมดไม่มีทรัพย์สินให้บังคับได้เลย โดยที่ดินทุกแปลงที่ตรวจพบติดจำนองทั้งสิ้น อีกทั้งรถยนต์ทุกคันที่ตรวจพบก็ติดสัญญาไฟแนนท์ทั้งสิ้น ภายหลังข้าพเจ้าได้สืบทราบอีกว่า นางสาวนภาภรณ์ มงคลเกตุ ได้หลอกลวงชาวต่างชาติคนอื่นอีกนอกจากข้าพเจ้า การกระทำของนางตามที่ข้าพเจ้าได้ทราบมาคือ ชายชาวต่างชาติคนนึงต้องการซื้อบ้านแต่ติดปัญหาตรงที่ไม่สามารถมีชื่อถือกรรมสิทธิ์ได้นางสาวนภาภรณ์ มงคลเกตุ จึงใช้ชื่อตนเองเป็นเจ้าของกรรมสิทธิ์แทนชายชาวต่างชาติดังกล่าวแล้วต่อมาภายหลังได้นำเอาที่ดินดังกล่าวไปจำนองและได้เป็นข้อพิพาทกันในศาล ซึ่งหนึ่งในที่ดินที่ทนายของข้าพเจ้าตรวจพบก็เป็นที่ดินพิพาทดังกล่าวด้วย ข้าพเจ้าไม่อาจทราบได้ว่าเงินจำนวน นับสิบล้านจะหายไปทั้งหมดได้อย่างไร
ด้วยเหตุดังกล่าวที่ได้แจ้งมานั้นข้าพเจ้าเกรงว่าหจก.กับพวกดังกล่าวจะกระทำการหลอกลวงชาวต่างชาติอื่นๆนอกเหนือจากที่ข้าพเจ้าทราบหรือในอนาคตที่อาจเกิดขึ้นได้ อีกทั้งการกระทำของหจกกับพวกดังกล่าวนั้นทำให้ข้าพเจ้าได้รับความเดือดร้อนอย่างมากทั้งสภาพความเป็นอยู่ ณ ปัจจุบันจึงใคร่ขอความกรุณาต่อคณะกรรมการปปง. ได้โปรดรับเรื่องของข้าพเจ้าไว้พิจารณาและช่วยเหลือข้าพเจ้าด้วย
