ประกาศกระทรวงพลังงาน
เรื่อง หลักเกณฑ์และวิธีการในการจัดให้มีการประกันภัยความรับผิดตามกฎหมายแก่ผู้ได้รับความเสียหาย
จากภัยอันเกิดจากการประกอบกิจการควบคุมประเภทที่ ๓
พ.ศ. ๒๕๕๗

อาศัยอ านาจตามความในข้อ ๕๗ แห่งกฎกระทรวงก าหนดหลักเกณฑ์ วิธีการ และเงื่อนไข
เกี่ยวกับการแจ้ง การอนุญาต และอัตราค่าธรรมเนียมเกี่ยวกับการประกอบกิจการน้ ามันเชื้อเพลิง
พ.ศ. ๒๕๕๖ ออกตามความในพระราชบัญญัติควบคุมน้ ามันเชื้อเพลิง พ.ศ. ๒๕๔๒ ซึ่งแก้ไขเพิ่มเติมโดย
พระราชบัญญัติควบคุมน้ ามันเชื้อเพลิง (ฉบับที่ ๒) พ.ศ. ๒๕๕๐ รัฐมนตรีว่าการกระทรวงพลังงาน
ออกประกาศไว้ดังต่อไปนี้
ข้อ ๑

ประกาศนี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป
ข้อ ๒ ในประกาศนี้
“ใบอนุญาต” หมายความว่า ใบอนุญาตประกอบกิจการควบคุมประเภทที่ ๓ ตามกฎกระทรวง
ก าหนดหลักเกณฑ์วิธีการ และเงื่อนไขเกี่ยวกับการแจ้ง การอนุญาต และอัตราค่าธรรมเนียมเกี่ยวกับ
การประกอบกิจการน้ ามันเชื้อเพลิง พ.ศ. ๒๕๕๖
“ผู้ได้รับความเสียหาย” หมายความว่า บุคคลธรรมดาหรือนิติบุคคลที่ได้รับความเสียหายแก่ชีวิต
ร่างกาย หรือทรัพย์สินจากอัคคีภัยหรือการระเบิดอันเกิดจากการประกอบกิจการควบคุมประเภทที่ ๓
แต่ไม่หมายความรวมถึงบุคคลในครอบครัวหรือบุคคลที่อยู่ด้วยกัน ซึ่งเกี่ยวข้องโดยตรงหรือโดยอ้อมของ
ผู้เอาประกันภัย หรือลูกจ้างของผู้เอาประกันภัยขณะอยู่ในระหว่างการว่าจ้าง หรือบุคคลซึ่งในขณะเกิดเหตุ
อยู่ในระหว่างการปฏิบัติงานให้ผู้เอาประกันภัยภายใต้สัญญาว่าจ้างหรือการฝึกงาน
ข้อ ๓ ให้ผู้รับใบอนุญาตต้องจัดให้มีการประกันภัยความรับผิดตามกฎหมายแก่ผู้ได้รับ
ความเสียหายจากอัคคีภัยหรือการระเบิดอันเกิดจากการประกอบกิจการควบคุมประเภทที่ ๓
ข้อ ๔ การประกันภัยความรับผิดตามกฎหมายอันเกิดจากการประกอบกิจการควบคุมน้ ามัน
ให้มีจ านวนเงินเอาประกันภัยส าหรับความเสียหายที่เกิดขึ้นต่อครั้งส าหรับการเสียชีวิต ทุพพลภาพถาวรสิ้นเชิง
หรือค่ารักษาพยาบาลและความเสียหายต่อทรัพย์สินของผู้ได้รับความเสียหายไม่น้อยกว่าจ านวน ดังต่อไปนี้
(๑) คลังน้ ามัน จ านวนเงินเอาประกันภัย ๒๕,๐๐๐,๐๐๐ บาท
(๒) สถานที่เก็บรักษาน้ ามัน ลักษณะที่สาม จ านวนเงินเอาประกันภัย ๑,๕๐๐,๐๐๐ บาท
(๓) สถานีบริการน้ ามันประเภท ก หรือประเภท ข จ านวนเงินเอาประกันภัย ๒,๐๐๐,๐๐๐ บาท
(๔) สถานีบริการน้ ามันประเภท ค ลักษณะที่สอง จ านวนเงินเอาประกันภัย ๑,๐๐๐,๐๐๐ บาท
(๕) สถานีบริการน้ ามันประเภท จ ลักษณะที่สอง จ านวนเงินเอาประกันภัย ๕๐๐,๐๐๐ บาท
