มาตรา 32
เพื่อผลประโยชน์ในทางเศรษฐกิจ การอนุรักษ์สิ่งแวดล้อม ความมั่นคง ความปลอดภัยของประเทศหรือ ของสาธารณชนให้รัฐมนตรีโดยการอนุมัติจากคณะรัฐมนตรีมีอำนาจกำหนดในเรื่องต่อไปนี้ (เฉพาะในส่วนที่สามารถ ใช้ในการควบคุมอากาศเสีย)
กำหนดจำนวนและขนาดของโรงงานแต่ละประเภท หรือชนิดที่จะให้ตั้ง หรือขยาย หรือที่จะไม่ให้ตั้งหรือขยายในท้องที่ใดท้องที่หนึ่ง
กำหนดชนิด คุณภาพ อัตราส่วน ของวัตถุดิบแหล่งกำเนิดของวัตถุดิบและปัจจัยหรือชนิดของพลังงานที่จะนำมาใช้หรือผลิตในโรงงาน
มาตรา 35
ให้พนักงานเจ้าที่ที่อำนาจดังต่อไปนี้(เฉพาะในส่วนที่สามารถใช้ในการควบคุมอากาศเสีย) เข้าไปในโรงงานหรืออาคารสถานที่หรือยานพาหนะที่มีเหตุสงสัยว่าจะประกอบกิจการโรงงาน ในระหว่างพระอาทิตย์ขึ้นถึงพระอาทิตย์ตกหรือในเวลาทำการของสถานที่ดังกล่าว เพื่อตรวจสภาพหรือการกระทำใดๆ ที่อาจะเป็นการฝ่าฝืนบทบัญญัติแห่งพระราชบัญญัติโรงงานนี้ ตรวจ ค้น กัก ยึด หรืออายัดผลิตภัณฑ์ ภาชนะบรรจุ สมุด บัญชี เอกสาร หรือสิ่งใดๆ ที่เกี่ยวข้องในกรณีที่มีเหตุสงสัยว่าการประกอบกิจการของโรงงานอาจก่อให้เกิดอันตรายแก่บุคคล หรือทรัพย์สินที่อยู่ในโรงงานหรือที่อยู่ใกล้เคียง หรือมีการกระทำผิดต่อพระราชบัญญัติโรงงานนี้
ผู้ใดขัดขวางหรือไม่ให้ความสะดวกแก่พนักงานเจ้าหน้าที่ต้องระวางโทษจำคุกไม่เกิน 1 เดือนหรือปรับไม่เกิน 20,000 บาท หรือทั้งจำทั้งปรับ (มาตรา 56)
มาตรา 37
ให้พนักงานเจ้าหน้าที่มีอำนาจสั่งให้ผู้ประกอบกิจการโรงงานที่ฝ่าฝืนหรือไม่ปฏิบัติตามพระราชบัญญัติ โรงงานนี้ หรือการประกอบกิจการโรงงงานมีสภาพที่อาจก่อให้เกิดอันตรายความเสียหาย หรือความเดือดร้อนแก่บุคคล หรือทรัพย์สินที่อยู่ในโรงงาน หรือที่อยู่ใกล้เคียงกับโรงงานระงับการกระทำที่ฝ่าฝืน หรือแก้ไขหรือปรับปรุงหรือปฏิบัติ ให้ถูกต้องหรือเหมาะสมภายในระยะเวลาที่กำหนด ใดไม่ปฏิบัติตามคำสั่งของพนังงานเจ้าหน้าที่ ต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 100,000 บาท หรือทั้งจำทั้งปรับ และให้ปรับอีกวันละไม่เกิน 5,000 บาท ตลอดเวลาที่ยังฝ่าฝืนหรือยังปฏิบัติไม่ถูกต้อง (มาตรา 57)
ในกรณีที่ผู้ประกอบกิจการโรงงานไม่ปฏิบัติตามคำสั่งของพนักงานหน้าที่ปลัด กระทรวงหรือผู้ที่ปลัดกระทรวง มอบหมาย มีอำนาจสั่งให ้เจ้าหน้าที่ มอบหมายให้บุคคลใดๆ เข้าจัดการแก้ไขเพื่อให้เป็นไปตามคำสั่งได้ โดยผู้ประกอบกิจการโรงงานต้องเป็น ผู้เสียค่าใช้จ่ายตามจำนวน ที่จ่ายจริง รวมกับเบี้ยปรับในอัตราร้อยล่ะ 30 ต่อปี ของจำนวนเงินดังกล่าว ในการดำเนินการดังกล่าว ให้ขอรับเงินช่วยเหลือ จากกองทุนสิ่งแวดล้อม และให้ชดใช้ เงินคืนแก่กองทุนสิ่งแวดล้อม เมื่อได้รับเงินจากผู้ประกอบกิจการโรงงาน (มาตรา 42)
ผู้ใดขัดขวางหรือไม่ให้ความสะดวกแก่บุคคลซึ่งปลัดกระทรวงหรือผู้ซึ่งปลัดกระทรวงมอบหมายให้เข้าจัดทำ เพื่อให้การเป็นไปตามคำสั่งตามมาตรา 42 ต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 100,000 บาท หรือทั้งจำทั้งปรับ (มาตรา 59)

มาตรา 39
ในกรณีผู้ประกอบกิจการโรงงานใดจงใจไม่ปฏิบัติตามคำสั่งของพนักงานเจ้าหน้าที่ตามมาตรา 37 โดยไม่มีเหตุอันควร หรือในกรณีที่ปรากฏว่าการประกอบกิจการของโรงงานใด อาจจะก่อให้เกิดอันตราย ความเสียหาย หรือความเดือดร้อนอย่างร้ายแรงแก่บุคคลหรือทรัพย์สินที่อยู่ในโรงงาน หรือที่อยู่ใกล้เคียงกับโรงงานให้ปลัดกระทรวง หรือผู้ที่ซึ่งปลัดกระทรวงมอบหมายมีอำนาจสั่งให้ผู้ประกอบกิจการโรงงานหยุดประกอบกิจการโรงงานทั้งหมดหรือบางส่วนเป็นการชั่วคราว และปรับปรุงแก้ไขโรงงานนั้นเสียใหม่หรือปฏิบัติให้ถูกต้องภายในระยะเวลาที่กำหนด
ผู้ประกอบกิจการโรงงาน สถาปนิกหรือวิศวกรฝ่าฝืนประกอบกิจการโรงงานในระหว่างที่ได้มีคำสั่ง ให้หยุดประกอบกิจการโรงงงานหรือภายหลัง ที่มีคำสั่งให้ปิดโรงงานต้องระวางโทษจำคุกไม่เกิน 2 ปี หรือปรับไม่เกิน 200,000 บาท หรือทั้งจำทั้งปรับและให้ปรับอีกวันล่ะ 5,000 บาท จนกว่าจะหยุดประกอบกิจการ (มาตรา 55)
ผู้ทำงานหรือคนงานอื่นๆ ที่ฝ่าฝืนให้ศาลพิจารณาลงโทษแล้วแต่กรณีโดยคำนึกถึงฐานะความรับผิดชอบ ต่อครอบครัว ความจงใจฝืนกฏหมายและความมีส่วนสำคัญในการกระทำ (มาตรา 35)
