บทความนี้เป็นการนำเสนอผลการทบทวนวรรณกรรมโดยศึกษาจากกฎหมายการคุ้มครองผู้ถูกกระทำความรุนแรงในครอบครัว เห็นว่าในปัจุบันความรุนแรงในครอบครัวเกิดขึ้นทั่วโลกและส่งผลกระทบทั้งทางด้านร่างกาย ด้านจิตใจ ของผู้ถูกกระทำในระยะยาว ทำให้มีกำหนดบทบัญญัติและออกข้อกฎหมายมารองรับ เพื่อเป็นการเยียวยาและคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัว อีกทั้งควรมีการบังคับใช้ให้มีความชัดเจนเด็ดขาด และควรบังคับใช้ให้เข้ากับลักษณะ สภาพสังคม ประเพณีและวัฒนธรรมของประเทศนั้นๆ โดยการศึกษาในครั้งนี้จะเน้นโดยทำการยกตัวอย่างกฎหมายที่บังคับใช้ในเรื่องการคุ้มครองผู้ถูกกระทำด้วยความรุนแรงในครอบครัวของ 2 ประเทศ อันได้แก่ ประเทศมาเลเซีย และประเทศสิงคโปร์ โดยนำกฎหมายทั้งสองประเทศมาเปรียบเทียบในเรื่องของประสิทธิภาพของการบังคับใช้กฎหมาย ซึ่งทั้งสองประเทศดังกล่าวมีข้อกฎหมายที่มีความแตกต่างในเรื่องสาระสำคัญในกฎหมายและรวมไปถึงอำนาจของศาลในการออกคำสั่งคุ้มครอง อาจจะมีผลทำให้ประสิทธิภาพในการบังคับใช้กฎหมายแตกต่างกัน ดังนั้นการนำกฎหมายทั้งสองประเทศนี้มาเปรียบเทียบประสิทธิภาพในการบังคับใช้นั้นอาจเป็นการชี้ให้เห็นว่าเรื่องการบังคับใช้กฎหมายถือว่ามีความสำคัญและจำเป็นเพื่อความมีประสิทธิภาพในการใช้กฎหมายให้เป็นไปตามวัตถุประสงค์ในการออกกฎหมายนั้นๆ โดยสามารถนำข้อดีและข้อเสียเพื่อดังกล่าวมาปรับประยุกต์ใช้กับกฎหมายหมายไทยในอนาคตต่อไป
