กรมป่าไม้ ได้รับหนังสือจากสำนักงานป่าไม้จังหวัดตราด แจ้งว่า ในที่ประชุมคณะอนุกรรมการป้องกันและปราบปรามการลักลอบทำลายทรัพยากรป่าไม้ ประจำอำเภอเขาสมิง ครั้งที่ 1/2538 เมื่อวันที่ 15 กันยายน พ.ศ. 2538 มีมติเห็นสมควรกำหนดพื้นที่ป่าบริเวณป่าเขาชะอม เขาคลองปุก และเขามะปริง ในเขตป่าสงวนแห่งชาติป่าเขาสมิง (ป่าคลองใหญ่-เขาไฟไหม้) อันเป็นพื้นที่ป่าอนุรักษ์ อยู่ในท้องที่อำเภอเขาสมิงและอำเภอบ่อไร่ จังหวัดตราด เป็นวนอุทยานหรืออุทยานแห่งชาติ เนื่องจากสภาพป่ายังคงความอุดมสมบูรณ์และมีสัตว์ป่าอยู่ชุกชุม กรมป่าไม้จึงมีคำสั่งที่ 55/2540 ลงวันที่ 10 มกราคม พ.ศ. 2540 ให้นายประยูร พงศ์พันธ์ เจ้าพนักงานป่าไม้ 5 ส่วนอุทยานแห่งชาติ ไปดำเนินการสำรวจพื้นที่ดังกล่าวและพื้นที่ใกล้เคียง จากการสำรวจข้อมูลเบื้องต้นมีความเห็นว่า พื้นที่บริเวณป่าเขาชะอม เขาคลองปุก เขามะปริง เขาแก้ว เขาตาบาด เขาตาโชติ และเขากำแพง สมควรจัดตั้งเป็นอุทยานแห่งชาติ โดยใช้ชื่อว่า อุทยานแห่งชาติน้ำตกคลองแก้ว
