ความยินยอมไม่เป็นละเมิด
ในกรณีที่ผู้เสียหายยินยอมให้กระทำหรือเสี่ยงเข้ารับความเสียหายนั้นเอง ถือไม่ได้ว่าผู้เสียหายที่ยินยอมนั้นได้รับความเสียหาย จึงไม่เป็นละเมิด แต่ทั้งนี้ตามกฎหมายว่าด้วยข้อสัญญาที่ไม่เป็นธรรมได้กำหนดว่า ความตกลงหรือยินยอมของผู้เสียหายสำหรับการกระทำที่ต้องห้ามชัดแจ้งโดยกฎหมายหรือขัดต่อความสงบเรียบร้อยหรือศีลธรรมอันดีของประชาชน จะนำมาอ้างเป็นเหตุยกเว้นหรือจำกัดความรับผิดเพื่อละเมิดมิได้ ดังนั้น ความยินยอมของผู้เสียหายที่ให้ผู้อื่นทำร้ายร่างกายถือได้ว่าเป็นการกระทำที่ต้องห้ามชัดแจ้งโดยกฎหมาย จึงเป็นละเมิด
