อาศัยอำนาจตามความในมาตรา ๒๗ และมาตรา ๒๘ แห่งพระราชบัญญัติส่งเสริมและรักษาคุณภาพสิ่งแวดล้อมแห่งชาติ พ.ศ. ๒๕๓๕ คณะกรรมการสิ่งแวดล้อมแห่งชาติออกประกาศ ดังต่อไปนี้

ข้อ ๑ ประกาศนี้เรียกว่า “ประกาศคณะกรรมการสิ่งแวดล้อมแห่งชาติ เรื่อง หลักเกณฑ์การจัดสรรเงินกองทุนสิ่งแวดล้อม”

ข้อ ๒[๑] ประกาศนี้ให้ใช้บังคับตั้งแต่วันถัดจากวันประกาศในราชกิจจานุเบกษาเป็นต้นไป

ข้อ ๓ ข้อกำหนดหรือแนวทางที่คณะกรรมการกองทุนสิ่งแวดล้อมกำหนดและขัดแย้งกับประกาศนี้ ให้ใช้ประกาศนี้แทน

ข้อ ๔ ในประกาศนี้
“คณะกรรมการ” หมายความว่า คณะกรรมการกองทุนสิ่งแวดล้อม

“รัฐวิสาหกิจ” หมายความว่า
(ก) องค์การของรัฐบาลหรือหน่วยงานธุรกิจที่รัฐบาลเป็นเจ้าของ
