“ผู้จัดสรรที่ดิน” หมายถึง ผู้ที่ได้รับใบอนุญาตให้ทำการจัดสรรที่ดินและให้ความหมายรวมถึงผู้รับโอนใบอนุญาตด้วย
“ผู้ซื้อที่ดินจัดสรร” หมายถึง ผู้ทำสัญญากับผู้จัดสรรที่ดินเพื่อให้ได้มาซึ่งที่ดินจัดสรร และให้ความหมายรวมถึงผู้รับโอนสิทธิในที่ดินคนต่อไปด้วย
“สมาชิก” หมายถึง สมาชิกนิติบุคคลหมู่บ้านจัดสรร ซึ่งจะประกอบไปด้วย ผู้จซื้อที่ดินจัดสรรทุกรายที่ได้ซื้อที่ดินจัดสรรจากผู้จัดสรรที่ดิน และผู้จัดสรรที่ดินในกรณีที่มีที่ดินจัดสรรแปลงย่อยที่ยังไม่มีผู้ใดซื้อ และได้โอนกลับมาเป็นของผู้จัดสรรที่ดิน

“เงินกองทุน” หมายถึง เงินทุนเมื่อเริ่มทำกิจการอย่างใดอย่างหนึ่ง ตามข้อบังคับหรือตามมติที่ประชุมใหญ่
“นิติบุคคลตามกฎหมายอื่น” หมายถึง นิติบุคคลตามกฎหมายอื่นที่จัดตั้งตามมาตรา 44 (1) แห่งพระราชบัญญัติการจัดสรรที่ดิน พ.ศ. 2543
“รัฐมนตรี” หมายถึง รัฐมนตรีผู้รักษาการตามพระราชบัญญัติการจัดสรรที่ดิน พ.ศ. 2543
ข้อ 3. การใช้ประโยชน์ภายในแปลงที่ดินจัดสรร ให้ใช้เพื่อการพักอาศัยเท่านั้น ยกเว้นบ้านเลขที่……….. ซึ่งสามารถประกอบกิจการพาณิชย์ได้ตามที่ปรากฏแล้วในผังโครงการ และการประกอบกิจการนั้น จะต้องไม่ขัดต่อกฎหมายหรือศีลธรรมอันดีหรือความสงบเรียบร้อยของหมู่บ้าน
การเปลี่ยนแปลงวัตถุประสงค์ใช้ประโยชน์จากที่กำหนดไว้ในข้อ 3 ไปใช้เพื่อใช้ประโยชน์อื่นๆ จะต้องได้รับความเห็นชอบของคณะกรรมการ และสมาชิกที่มีอาณาเขตที่ดินแปลงติดๆกัน
ข้อ 4. ข้อบังคับนี้ให้ใช้บังคับผู้จัดสรรที่ดิน สมาชิก คณะกรรมการหมู่บ้านจัดสรร ผู้จัดการ พร้อมทั้งบริวารหรือผู้แทนทุกคนภายในหมู่บ้านจัดสรร และให้บังคับใช้รวมถึงผู้ใช้บริการอื่นๆ นับแต่วันที่ได้จดทะเบียนเป็นต้นไป การเปลี่ยนแปลงข้อบังคับให้เป็นไปตามข้อมติที่ประชุมใหญ่ภายใต้บัญญัติแห่งพระราชบัญญัติ และข้อบังคับนี้ถ้ามีมติถูกต้องแล้วให้คณะกรรมการนำไปจดทะเบียนต่อเจ้าพนักงาน เจ้าหน้าที่ และเมื่อเจ้าหน้าที่ไดจดทะเบียนเปลี่ยนแปลงแล้ว จึงมีผลสมบูรณ์บังคับใช้
ข้อ 5. นอกจากที่ได้ตราไว้ในข้อบังคับแล้ว ให้ใช้บทบัญญัติแห่งพระราชบัญญัติ , กฎกระทรวง , ระเบียบของคณะกรรมการจัดสรรที่ดินกลางเป้นข้อบังคับของนิติบุคคลหมู่บ้านจัดสรร
ข้อ 6. นิติบุคคลหมู่บ้านจัดสรร มีวัตถุประสงค์เพื่อจัดการ ดูแลทรัพย์ สาธารณูปโภค , บริการสาธารณะ ตลอดจนบัญชีการเงิน และความเรียบร้อยภายในหมู่บ้าน และให้มีอำนาจกระทำการใดๆ เพื่อประโยชน์สูงสุดในการอยู่อาศัยและการใช้ร่วมกัน ทั้งนี้ให้เป็นไปตามวัตถุประสงค์และมติของที่ประชุมใหญ่ และ/หรือ มติของคณะกรรมกรรหมู่บ้านจัดสรรภายใต้บทบัญญัติแห่งพระราชบัญญัติ เช่น
6.1 กำหนดระเบียบเกี่ยวกับการใช้ประโยชน์สาธารณูปโภคและบริการสาธารณะ
6.2 กำหนดระเบียบเกี่ยวกับการอยู่อาศัยและการจราจรภายในที่ดินจัดสรร
6.3 เรียกเก็บเงินค่าใช้จ่ายในการบำรุงรักษาและการจัดการสาธารณูปโภคในส่วนที่นิติบุคคลหมู่บ้านจัดสรรมีหน้าที่บำรุงรักษาจากสมาชิก
6.4 ยื่นคำร้องทุกข์หรือเป็นโจทก์ฟ้องแทนสมาชิกเกี่ยวกับกรณีที่กระทบสิทธิหรือประโยชน์ของสมาชิกจำนวนตั้งแต่สิบรายขึ้นไป
