(๓) คนวิกลจริต ซึ่งศาลสั่งให้เป็นคนไร้ความสามารถ (คนบ้า) หากได้ทำพินัยกรรม พินัยกรรมเป็นโมฆะ ถ้าศาลยังไม่สั่งให้เป็นคนไร้ความสามารถ พินัยกรรมนั้นใช้ได้ จะใช้ไม่ได้ (เสียเปล่า) ก็ต่อเมื่อพิสูจน์ได้ว่าบุคคลนั้นได้ทำพินัยกรรมในขณะที่บุคคลนั้นเป็นคนวิกลจริต

(๔) คนเสมือนไร้ความสามารถ ทำพินัยกรรมได้มีผลสมบูรณ์
