มาตรา 12
ผู้ใดจัดให้มีการเล่น หรือทำอุบายล่อ ช่วยประกาศโฆษณา หรือ ชักชวนโดยทางตรงหรือทางอ้อมให้ผู้อื่นเข้าเล่นหรือเข้าพนันในการ เล่นซึ่งมิได้รับอนุญาตจากเจ้าพนักงานหรือรับอนุญาตแล้วแต่เล่นพลิกแพลง หรือผู้ใดเข้าเล่นหรือเข้าพนันในการเล่นอันขัดต่อ บทแห่งพระราช บัญญัตินี้ หรือกฎกระทรวง หรือข้อความในใบอนุญาต ผู้นั้นมีความผิดต่อไปนี้

(1) ถ้าเป็นความผิดในการเล่นตามบัญชี ก. หมายเลข 1 ถึงหมายเลข 16 หรือ การเล่นตามบัญชี ข. หมายเลข 16 เฉพาะสลากกินรวบ หรือ การเล่นซึ่งมีลักษณะคล้ายกันนี้ ต้องระวางโทษจำคุกตั้งแต่ 3 เดือนขึ้นไปจนถึง 3 ปี และปรับตั้งแต่ 500 บาท ขึ้นไปจนถึง 5,000 บาท ด้วยอีก โสดหนึ่ง เว้นแต่ผู้เข้าเล่นหรือเข้าพนันที่เรียกว่าลูกค้า ให้จำคุกไม่เกิน 3 ปี หรือปรับไม่เกิน 5,000 บาท หรือทั้งจำทั้งปรับ
(2) ถ้าเป็นความผิดในการเล่นอื่นใดตามพระราชบัญญัตินี้ ต้องระวางโทษจำคุก ไม่เกิน 2 ปี หรือปรับไม่เกิน 2,000 บาท หรือทั้งจำทั้งปรับ เว้น แต่ความผิดตามมาตรา 4ทวิต้องระวางโทษจำคุกไม่เกิน 1 ปี หรือปรับไม่เกิน 1,000 บาท หรือทั้งจำทั้งปรับ

มาตรา 14
ผู้ใดกระทำความผิด ต้องระวางโทษตามพระราชบัญญัตินี้เมื่อพ้นโทษแล้วยังไม่ครบกำหนดสามปีกระทำความผิดต่อพระราชบัญญัตินี้อีก
(1) ถ้าโทษซึ่งกำหนดไว้สำหรับความผิดที่กระทำครั้งหลังเป็นโทษจำคุก และ ปรับ ให้วางโทษทวีคูณ
(2) ถ้าโทษซึ่งกำหนดไว้สำหรับความผิดที่กระทำครั้งหลังเป็นโทษจำคุก หรือ ปรับ ให้วางโทษทั้งจำทั้งปรับ
