โทษ

พระราชบัญญัติการพะนัน พุทธศักราช 2478 มาตรา 9 ตรี , มาตรา 10 , มาตรา 11 , มาตรา 12 , มาตรา 13 และมาตรา 14 สามารถแบ่งแยกได้เป็น 2 ประเภท คือ

1. การเรียกคืนใบอนุญาตตามมาตรา 11 เมื่อมีเหตุสมควรเชื่อว่าผู้รับใบอนุญาตกระทำการละเมิดพระราชบัญญัตินี้ หรือกฎกระทรวง หรือใบอนุญาตซึ่งออกตามพระราชบัญญัตินี้

2. โทษอาญาทั่วไป คือจำคุก กักขัง ปรับ และริบทรัพย์สินตามที่บัญญัติไว้ในมาตรา 18 แห่งประมวลกฎหมายอาญา โดยโทษสำหรับการกระทำความผิดเกี่ยวกับการพนันมีดังนี้

โทษจำคุก และโทษปรับ ตามที่บัญญัติไว้ในมาตรา 9 ตรี , มาตรา 12 , มาตรา 13 และมาตรา 14
โทษริบทรัพย์สินตามที่บัญญัติไว้ในมาตรา 10
นอกจากโทษตามที่กล่าวมาแล้ว มาตรา 15 ยังกำหนดให้ในกรณีที่มีผู้นำจับผู้กระทำความผิด ให้พนักงานอัยการร้องขอต่อศาลให้จ่ายสินบนแก่ผู้นำจับด้วยและให้ศาลสั่งไว้ในคำพิพากษาให้ผู้กระทำผิดใช้เงินสินบนแก่ผู้นำจับกึ่งหนึ่งของจำนวนเงินค่าปรับด้วย
