บทคัดย่อ
วิทยานิพนธ์นี้มีวัตถุประสงค์เพื่อศึกษาปัญหากฎหมายและมาตรการคุ้มครองผู้บริโภคด้านความปลอดภัยสินค้าอาหารสำเร็จรูปแช่แข็ง เนื่องจากอาหารสำเร็จรูปแช่แข็งในประเทศไทยเป็นที่นิยมของผู้บริโภคเป็นอย่างมาก แต่ในปัจจุบันยังไม่มีบทบัญญัติของกฎหมายที่บัญญัติขึ้นมาเพื่อใช้ควบคุมการผลิตอาหารสำเร็จรูปแช่แข็งไว้เป็นการเฉพาะ จึงยังคงพบปัญหาของการผลิตอาหารสำเร็จรูปแช่แข็งที่ไม่ถูกสุขลักษณะ ซึ่งมีผลต่อชีวิต อนามัยและร่างกายของผู้บริโภคโดยตรง
จากการศึกษากฎหมายที่เกี่ยวข้องกับการควบคุมการผลิตอาหารสำเร็จรูปแช่แข็งในปัจจุบัน ถึงแม้ว่าจะมีบทบัญญัติที่กำหนดให้ผู้ประกอบการต้องดำเนินการผลิตให้เป็นไปตามกฎหมายเพื่อการคุ้มครองผู้บริโภค แต่ก็ยังคงพบปัญหาคุณภาพและความปลอดภัยของอาหารสำเร็จรูปแช่แข็งซึ่งทำให้เกิดอันตรายต่อผู้บริโภค หากนำหลักกฎหมายฉบับอื่นๆมาปรับใช้ในการควบคุมการผลิตอาหารสำเร็จรูปแช่แข็ง โดยในกฎหมายฉบับต่างๆที่นำมาใช้ควบคุมการผลิตอาหารสำเร็จรูปแช่แข็งนั้นก็จะมีหน่วยงานหรือองค์กรรับผิดชอบที่เกี่ยวข้องหลายหน่วยงาน แต่ไม่มีองค์กรหรือหน่วยงานกลางที่ทำหน้าที่ประสานงานระหว่างหน่วยงานที่เกี่ยวข้องกับการควบคุมหรือแก้ไขปัญหาดังกล่าวอันส่งผลทำให้การปฏิบัติงานไม่มีประสิทธิภาพทั้งนี้ ผู้เขียนได้ทำการศึกษากฎหมายไทยเปรียบเทียบกับต่างประเทศว่าด้วยเรื่องอาหารเกี่ยวกับอาหารสำเร็จรูปแช่แข็ง ได้แก่ ประเทศสหรัฐอเมริกา กลุ่มประเทศสหภาพยุโรป และประเทศสิงคโปร์ เพื่อใช้เป็นแนวทางในการปรับปรุงแก้ไขกฎหมายเกี่ยวกับการคุ้มครองผู้บริโภคเกี่ยวกับอาหารสำเร็จรูปแช่แข็งให้เกิดประสิทธิภาพ
ดังนั้น วิทยานิพนธ์นี้จึงเสนอแนะแนวทางในการแก้ไขปัญหาต่างๆเกี่ยวกับการควบคุมการผลิตอาหารสำเร็จรูปแช่แข็ง ดังนี้ คือ (1)ควรให้มีการแก้ไขประกาศกระทรวงสาธารณสุข โดยนำมาตรฐานระบบวิเคราะห์อันตรายและควบคุมจุดวิกฤติ (HACCP) มาใช้ควบคุมความปลอดภัยทางด้านอาหารสำเร็จรูปแช่แข็งที่ผลิตหรือวางจำหน่ายในประเทศไทย (2)ควรกำหนดหลักเกณฑ์เพื่อควบคุมการขนส่งสินค้าอาหารเป็นการเฉพาะในพระราชบัญญัติอาหาร พ.ศ. 2522 (3)ควรเพิ่มมาตรการเรียกคืนสินค้าอาหาร หากพบว่ามีการวางจำหน่ายสินค้าอาหารที่ไม่ปลอดภัยต่อผู้บริโภค ทั้งนี้ เพื่อให้สอดคล้องกับเจตนารมณ์ตามพระราชบัญญัติอาหาร พ.ศ. 2522
