ห้ามมิให้ผู้ให้เช่าบอกเลิกสัญญาจนกว่าจะครบอายุสัญญา เว้นแต่ผู้เช่าผิดสัญญาในข้อสาระสำคัญ หรือผู้เช่าได้แสดงเจตนาบอกเลิกเป็นลายลักษณ์อักษรล่วงหน้า 30 วันให้ผู้ให้เช่ารับทราบ ซึ่งบรรดาสิ่งปลูกสร้างที่ติดตรึงอยู่กับที่ดินของผู้ให้เช่าให้ตกแก่ผู้ให้เช่าทั้งสิ้น
