สัญญาเช่าฉบับนี้ทำขึ้นระหว่าง นางจิตรา กิตตานันทวงษ์ อยู่บ้านเลขที่ 50 ซ.พัฒนาการ 17 ถ.พัฒนาการ เขตสวนหลวง กรุงเทพมหานคร ซึ่งต่อไปในสัญญาฉบับนี้จะเรียกว่า “ผู้ให้เช่า” ฝ่ายหนึ่ง กับ นายมนตรี อัครเดชสุนทร บ้านเลขที่ 678/11ซอย พัฒนาการ44 แขวงสวนหลวง เขตสวนหลวง จังหวัด กรุงเทพมหานคร ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ผู้เช่า” อีกฝ่ายหนึ่งทั้งสองฝ่ายได้ตกลงทำสัญญากันซึ่งมีข้อความดังต่อไปนี้
ข้อ 1. ผู้ให้เช่าตกลงให้เช่าและผู้เช่าตกลงรับเช่าบ้านเลขที่ 790/14 ซอยทองหล่อ 18 ถนนสุขุมวิท 55
แขวงคลองตัน กรุงเทพมหานคร เพื่อเป็นที่อยู่อาศัย โดยมีกำหนดเวลาเช่า 12 เดือน นับตั้งแต่วันที่ 1 มกราคม 2557 ถึงวันที่ 31 ธันวาคม 2557 ในอัตราค่าเช่าเดือนละ 17,000 บาท (หนึ่งหมื่นเจ็ดพันบาทถ้วน) กำหนดการชำระค่าเช่าเป็นรายเดือนให้แก่ผู้ให้เช่า ณ ภูมิลำเนาของผู้ให้เช่า ภายในวันที่ 1 ของทุกๆเดือน ค่าเช่าเดือนแรกเริ่มตั้งแต่เดือน มกราคม 2557 เป็นต้นไป
ข้อ 2. ในวันทำสัญญานี้ผู้เช่าได้วางเงินมัดจำ 42,000 บาท (สี่หมื่นสองพันบาทถ้วน) ไว้ให้แก่ผู้ให้เช่าเพื่อเป็นประกันการเสียหายอันอาจจะเกิดขึ้นในระหว่างการเช่าเงินมัดจำนี้ผู้ให้เช่าจะคืนให้แก่ผู้เช่าเมื่อเลิกสัญญานี้แล้ว แต่ถ้าหากผู้เช่าผิดชำระค่าเช่าเป็นเวลา 2 เดือน ผู้ให้เช่ามีสิทธิยกเลิกสัญญาเช่าและยึดเงินมัดจำที่ทำไว้ให้แก่ผู้เช่า
ข้อ 3. ผู้เช่ายินยอมออกค่าไฟฟ้า ค่าน้ำประปา ค่าใช้จ่ายส่วนกลาง ค่าโทรศัพท์ ค่าเก็บขยะมูลฝอย และ ค่าภาษีโรงเรือนบ้านที่เช่า
ข้อ 4. ผู้เช่าต้องรักษาซ่อมแซมบ้านที่เช่ามิให้ชำรุดทรุดโทรมไปจากสภาพที่เป็นอยู่ขณะที่ทำสัญญานี้ ถ้าบ้านที่เช่ามีการเสียหายเกิดขึ้นในระหว่างการเช่า ผู้เช่าจะต้องทำการซ่อมแซมให้เรียบร้อยเหมือนเดิมด้วยทุนทรัพย์ของผู้เช่าเอง และเมื่อสัญญานี้หากเพิกถอนด้วยประการใด ก็ตามผู้เช่าต้องส่งมอบบ้านที่เช่าคืนในสภาพที่ว่านี้โดยครบถ้วน
ข้อ 5. ผู้เช่าจะกระทำการดังต่อไปนี้ไม่ได้ถ้าไม่ได้รับความยินยอมเป็นลายลักษณ์อักษรจากผู้ให้เช่าเสียก่อน คือ.-
(1) การให้เช่าช่วงหรือการโอนสิทธิการเช่า
(2) การดัดแปลง ต่อเติม หรือรื้อถอนส่วนหนึ่งส่วนใดของทรัพย์สินที่เช่า
ข้อ 6. หากผู้เช่าได้ทำการดัดแปลงหรือติดเติมสิ่งปลูกสร้างใดๆ ขึ้นใหม่ในบ้านที่เช่าลงไปแล้วต้องตก เป็นทรัพย์สินของผู้ให้เช่าทั้งสิน โดยผู้เช่าไม่มีสิทธิที่จะเรียกร้องเอาค่าชดใช้ใดๆ ทั้งสิ้นเป็นอัดขาด
ข้อ 7. ห้ามนำสิ่งของที่ผิดกฎหมายหรือเป็นอัคคีภัย เช่น น้ำมัน เชื้อเพลิง ฯลฯ เข้ามาไว้ในบ้านที่เช่าเป็นอันขาด
ข้อ 8. ผู้ให้เช่าเป็นผู้ประกันอัคคีภัยบ้านที่ให้เช่าเอง
ข้อ 9. หากในระหว่างการเช่าบ้านที่เช่าบังเอิญเป็นอันตรายไปด้วยอัคคีภัยเหตุสุดวิสัยหรือสลักหักพังโดยเหตุผลใดๆ ก็ตาม สัญญาฉบับนี้เป็นอันสิ้นสุดลงดุจกันผู้เช่าจะคงอยู่เพื่อรดการปลูกสร้างขึ้นมาใหม่ไม่ได้
ข้อ 10. ผู้เช่าต้องให้ความสะดวกสบายต่อผู้ให้เช่าทุกๆ ครั้งที่ผู้ให้เช่าต้องการจะเข้ามาตรวจบ้านที่เช่าในเวลาปกติ
ข้อ 11. หากผู้เช่ามีความประสงค์จะเช่าต่อไปเมื่อครบกำหนดเวลาเช่า ผู้เช่าจะต้องแจ้งให้ผู้ให้เช่าทราบเป็นลายลักษณ์อักษรก่อนครบกำหนดเวลาเช่าหนึ่งเดือน หากผู้ให้เช่ามีความประสงค์จะขอรับบ้านที่เช่าคืนเมื่อครบกำหนดเวลาเช่า ผู้ให้เช่าต้องแจ้งให้ผู้เช่าทราบเป็นลายลักษณ์อักษรก่อนครบกำหนดเวลาเช่า ผู้ให้เช่าต้องแจ้งให้ ผู้เช่าทราบเป็นลายลักษณ์อักษรก่อนครบกำหนดเวลาเช่าหนึ่งเดือนเช่นกัน
ข้อ 12. หากผู้เช่าผิดสัญญาข้อหนึ่งข้อใดก็ดี ผู้เช่ายินยอมให้ผู้ให้เช่าบอกเลิกสัญญานี้ทันที
