กรณีที่นายจ้างไม่สามารถจัดให้มีวิธีการดำเนินการเพื่อป้องกันมิให้ลูกจ้างได้รับอันตรายตามวรรคหนึ่งได้ นายจ้างต้องออกแบบอุปกรณ์ช่วยเพื่อให้เกิดความปลอดภัยหรือกำหนดขั้นตอนการทำงานให้ปลอดภัยได้ และแจ้งให้อธิบดีหรือผู้ซึ่งอธิบดีมอบหมายทราบโดยไม่ชักช้า
