สัญญาจ้างเหมาก่อสร้างบ้านเดี่ยวสองชั้น

สัญญาฉบับนี้ทำขึ้นที่ 264 หมู่ 3 ต.กร่ำ อ.แกลง จ.ระยอง ระหว่าง บริษัท แม่พิมพ์ โอเชี่ยน เบย์ ทะเบียนเลขที่ 0215555003755 อยู่บ้านเลขที่ 264 หมู่ 3 ต.กร่ำ อ.แกลง จ.ระยอง ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ผู้ว่าจ้าง” ฝ่ายหนึ่ง กับ______________________ ถือบัตรประจำตัวประชาชนหมายเลข _________________ อยู่บ้านเลขที่ _____________________ซึ่งต่อไปในสัญญานี้จะเรียกว่า “ผู้รับจ้าง” อีกฝ่ายหนึ่ง
คู่สัญญาทั้งสองฝ่ายตกลงทำสัญญากันดังมีข้อความต่อไปนี้

ข้อ1. “ผู้ว่าจ้าง” ตกลงว่าจ้างและ “ผู้รับจ้าง” ตกลงรับจ้างก่อสร้างอาคารพักอาศัยบ้านเดี่ยวสองชั้น จำนวน 1 หลังบนที่ดิน PLOT 9 ของโครงการ “แม่พิมพ์ โอเชี่ยน เบย์” ซึ่งตั้งอยู่ หมู่ 6 ตำบลกร่ำ อำเภอแกลง จังหวัดระยอง
ข้อ 2. “ผู้รับจ้าง” ตกลงจะทำการก่อสร้างตามสัญญาข้อ 1 ให้เสร็จสิ้นภายในกำหนด _______ วัน โดยจะเริ่มดำเนินการก่อสร้างในวันที่ _____ เดือน ________ พ.ศ. 2557 และจะดำเนินการก่อสร้างดังกล่าวให้แล้วเสร็จ ในวันที่ _____ เดือน ________ พ.ศ. 2557 ทั้งนี้ต้องก่อสร้างตามรูปแบบ แบบแปลน ใบเสนอราคา และรายละเอียดกำหนดการดำเนินงานที่แนบท้ายสัญญานี้และถือว่าเป็นส่วนหนึ่งของสัญญาฉบับนี้ด้วย
ข้อ 3. คู่สัญญาตกลงราคาค่าจ้างเหมาก่อสร้างรวมเป็นเงินทั้งสิ้น -800,661-บาท (-แปดแสนหกร้อยหกสิบเอ็ดบาทถ้วน.-) “ผู้ว่าจ้าง” ตกลงชำระค่าจ้างเหมารวมค่าวัสดุสิ่งของทั้งหลายตามเงื่อนไขดังต่อไปนี้:
3.1 งวดที่1 เมื่อ “ผู้รับจ้าง” ได้ทำงานเตรียมการ และวางผังบริเวณ “ผู้ว่าจ้าง” ตกลงชำระค่าจ้างในอัตราร้อยละ 10
ของค่าเหมารวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.2 งวดที่2 เมื่อ “ผู้รับจ้าง” ได้ทำงานขุดดิน ฐานราก เสาตอม่อ แล้วเสร็จ “ผู้ว่าจ้าง” ตกลงชำระค่าจ้าง ในอัตราร้อย
ละ10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.3 งวดที่3 เมื่อ “ผู้รับจ้าง”ได้ทำงานคานคอดิน เทพื้น เสารับหลังคา แล้วเสร็จ “ผู้ว่าจ้าง” ตกลงชำระค่าจ้าง ในอัตรา
ร้อยละ10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.4 งวดที่4 เมื่อ “ผู้รับจ้าง” ได้ทำงานโครงเหล็กรับหลังคา แล้วเสร็จ “ผู้ว่าจ้าง” ตกลงชำระค่าจ้างใน
อัตราร้อยละ 10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.5 งวดที่5 เมื่อ “ผู้รับจ้าง” ได้ทำงานก่ออิฐ และเดินท่อไฟ-ท่อประปา แล้วเสร็จ “ผู้ว่าจ้าง” ตกลง ชำระค่าจ้างใน
อัตราร้อยละ 10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.6 งวดที่6 เมื่อ “ผู้รับจ้าง” ได้ทำงานฉาบปูนผนัง ติดตั้งวงกบประตู แล้วเสร็จ “ผู้ว่าจ้าง” ชำระค่าจ้างในอัตราร้อย
ละ 10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.7 งวดที่7 เมื่อ “ผู้รับจ้าง” ได้ทำงานมุงหลังคาพร้อมติดตั้งเชิงชาย และวางถังบำบัด แล้วเสร็จ “ผู้ว่าจ้าง” ชำระ
ค่าจ้างในอัตราร้อยละ 10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.8 งวดที่8 เมื่อ “ผู้รับจ้าง” ได้ทำงานฝ้าภายใน-ภายนอก งานปูกระเบื้อง แล้วเสร็จ “ผู้ว่าจ้าง” ชำระค่าจ้างในอัตรา
ร้อยละ 10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)
3.9 งวดที่9 เมื่อ “ผู้รับจ้าง” ได้ทำงานเดินไฟฟ้า ประปา ติดตั้งบานประตู-หน้าต่าง แล้วเสร็จ “ผู้ว่าจ้าง” ชำระค่าจ้าง
ในอัตราร้อยละ 5 ของค่าเหมา รวมเป็นเงิน -40,033.-บาท (-สี่หมื่นสามสิบสามบาทถ้วน-)
3.10งวดที่10 เมื่อ “ผู้รับจ้าง” ได้ทำงานติดตั้งเครื่องไฟฟ้า สุขภัณฑ์ แล้วเสร็จ “ผู้ว่าจ้าง” ชำระค่าจ้าง ในอัตราร้อยละ
5 ของค่าเหมา รวมเป็นเงิน -40,033.-บาท (-สี่หมื่นสามสิบสามบาทถ้วน-)
3.11 งวดที่11 เมื่อ “ผู้รับจ้าง” ได้ทำงานทาสี เก็บความเรียบร้อย ล้างบ้าน ส่งงาน แล้วเสร็จ “ผู้ว่าจ้าง ชำระค่าจ้างใน
อัตราร้อยละ 10 ของค่าเหมา รวมเป็นจำนวนเงิน –80,066.-บาท (-แปดหมื่นหกสิบหกบาทถ้วน-)

ข้อ4. “ผู้รับจ้าง” จะเป็นผู้ดำเนินการจัดหาเครื่องมือเครื่องใช้รวมทั้งสัมภาระต่างๆ ที่ต้องใช้ในการก่อสร้าง
ข้อ5. “ผู้รับจ้าง” จะเป็นผู้ดำเนินการจัดหาวัสดุสิ่งของที่ใช้ในการก่อสร้างตามรายการวัสดุแนบท้ายสัญญานี้และอีกทั้งเป็นผู้รับภาระในค่าไฟฟ้า-ค่าน้ำประปาที่ถูกใช้ไปโดยลูกจ้างของผู้รับจ้างอันเนื่องจากการตั้งแค้มป์พำนักอาศัย
ข้อ6. “ผู้รับจ้าง” จะต้องจัดหาช่างฝีมือและชำนาญการก่อสร้าง เข้าทำการก่อสร้าง และจัดหาเครื่องจักร เครื่องมือที่ทันสมัยเป็นไปตามหลักด้านวิศวกรรมมาใช้ในการก่อสร้าง
ข้อ 7. งานก่อสร้างตามสัญญาฉบับนี้ไม่รวมถึงงานและค่าใช้จ่ายต่อไปนี้
6.1 ค่าธรรมเนียมการขออนุญาตทุกชนิด
6.2 สนามหญ้า
6.3 ค่าธรรมเนียมสำหรับมิเตอร์น้ำประปาและไฟฟ้า
6.4 งานประปาและไฟฟ้านอกอาคาร
ข้อ 8. “ผู้รับจ้าง” ยินยอมให้ “ผู้ว่าจ้าง” หรือตัวแทน เข้าตรวจตราอาคารที่ก่อสร้างได้ตลอดเวลาและ “ผู้ว่าจ้าง” หรือตัวแทนมีสิทธิตรวจงานก่อสร้างให้เป็นไปตามแบบรูปรายการประกอบแบบ แต่ต้องไม่เป็นการรบกวนหรือขัดขวางการทำงานของ “ผู้รับจ้าง”
ข้อ 9. ในกรณีที่ “ผู้ว่าจ้าง” ประสงค์จะทำการแก้ไข เปลี่ยนแปลง หรือเพิ่มเติมรูปแบบหรือรายละเอียด
ของบ้านหรือสิ่งปลูกสร้าง “ผู้ว่าจ้าง”ต้องทำการแจ้งให้ “ผู้รับจ้าง” ทราบเป็นลายลักษณ์อักษรล่วงหน้าไม่น้อยกว่า
7 วัน โดย”ผู้ว่าจ้าง” ต้องรับผิดชอบค่าใช้จ่ายที่เกิดขึ้น ทั้งนี้ “ผู้รับจ้าง “สงวนสิทธิ์ที่จะยอมรับหรือไม่ยอมรับ
การแก้ไขเปลี่ยนแปลงหรือเพิ่มเติมนั้น โดยคำนึงถึงความจำเป็นและผลเสียหายอันอาจเกิดขึ้นได้เนื่องจากการแก้ไขเปลี่ยนแปลง หรือเพิ่มเติมนั้น
ข้อ 10. การตรวจรับงาน
ข้อ 10.1 “ผู้ว่าจ้าง”หรือตัวแทน ต้องทำการตรวจรับงานภายในเวลา 5 วัน นับแต่วันที่ได้รับการแจ้งจาก “ผู้รับจ้าง” หากไม่ตรวจรับงานภายในเวลาดังกล่าว ให้ถือว่าได้ตรวจรับงานแล้วโดยปริยาย
ข้อ 10.2 หาก“ผู้ว่าจ้าง”หรือตัวแทน เข้าตรวจงานแล้วพบข้อบกพร่องงานที่ไม่เป็นไปตามมาตรฐานวิชาชีพ“ผู้ว่าจ้าง” จะแจ้งให้ “ผู้รับจ้าง” ทราบทันที และ“ผู้รับจ้าง” จะต้องรีบดำเนินการแข้ไขให้แล้วเสร็จ ภายใน 7 วัน

ข้อ 11. “ผู้รับจ้าง” สงวนสิทธิ์ที่จะนำงานบางส่วนตามสัญญาฉบับนี้ไปให้ผู้อื่นทำได้ ทั้งนี้”ผู้รับจ้าง” จะเป็นผู้รับผิดชอบในงานก่อสร้างนั้นเองทุกประการเสมือนหนึ่งว
