ตามที่ท่านได้ทำสัญญาเช่าห้องชุดยูนิต P8 กับบริษัท เมอลิน คอนสตรัคชั่นโฮลดิ้ง จำกัด โดยในสัญญาระบุว่า กำหนดระยะเวลาเช่า 30 ปี และกำหนดก่อสร้างให้แล้วเสร็จพร้อมส่งมอบในวันที่ 30 มิถุนายน 2559 รายละเอียดตามที่ท่านทราบดีอยู่แล้วนั้น
ปรากฏว่า จากการตรวจสอบ ณ ปัจจุบัน ท่านได้ผิดสัญญา โดยโครงการของท่านทำการก่อสร้างล่าช้าเป็นอย่างมาก และยังไม่สามารถส่งมอบให้ทันภายในกำหนด และบัดนี้ได้ล่วงเลยเวลาตามสัญญาฉบับที่อ้างถึงข้างต้น ทำให้ บริษัทฯ ได้รับความเสียหาย อันเนื่องมาจากไม่ได้ใช้ประโยชน์ในทรัพย์ และไม่สามารถเข้าครอบครองได้ และเมื่อพิจรณาแล้ว สามารถเล็งเห็นได้ว่า ท่านจะไม่สามารถดำเนินการจดทะเบียนเช่า 30 ปี ห้องชุดดังกล่าวข้างต้นได้ทันตามกำหนดไว้ในสัญญา
การที่ท่านผิดสัญญาทำให้ทาง บริษัทฯ ได้รับความเสียหาย เพราะขาดประโยชน์จากการใช้สอย คิดเป็นเงินเดือนละ 200,000 บาท
ข้าพเจ้าในฐานะทนายความผู้รับมอบอำนาจจาก บริษัท เมอลิน คอนสตรัคชั่นโฮลดิ้ง จำกัด จึงขอให้ท่านนำเงินจำนวน เดือนละ 200,000 บาท มาชำระให้กับบริษัทฯ จนกว่าจะก่อสร้างเสร็จสมบูรณ์ ในทุกวันที่ 5 ของเดือน นับถัดจากวันที่ท่านผิดสัญญา และให้ท่านทำการชี้แจงเป็นหนังสือให้กับบริษัทฯ ได้ทราบว่าท่านจะสามารถทำการก่อสร้างให้แล้วเสร็จ พร้อมกำหนดวันส่งมอบในสภาพที่สมบูรณ์ ใช้งานได้เมื่อไหร่ นับแต่วันที่ท่านได้รับหนังสือฉบับนี้ ภายใน 15 วัน มิฉะนั้น ทางบริษัท เมอลิน คอนสตรัคชั่นโฮลดิ้ง จำกัด ก็มีความจำเป็นที่จะต้องดำเนินคดีตามกฎหมายกับท่านต่อไป
