ทั้งสองฝ่ายได้ตกลงทำสัญญากัน โดยมีข้อความดังต่อไปนี้



ข้อ 1. ผู้ให้สัญญาตกลงให้ผู้รับสัญญามีสิทธิเก็บกินในทรัพย์สิน โดยให้มีสิทธิจะครอบ

ครองใช้สอยและถือเอาซึ่งประโยชน์จากทรัพย์สินดังกล่าว ตลอดทั้งให้มีอำนาจในการจัดการ

ทรัพย์สินได้ด้วย

ข้อ 2. สิทธิเก็บกินตามข้อ 1 ให้มีกำหนดเวลา……………….ปี นับแต่วันทำสัญญานี้

ข้อ 3. ในกรณีที่ผู้รับสัญญาถึงแก่ความตายก่อนครบกำหนดเวลา ให้ถือว่าสิทธิเก็บกินตาม

สัญญานี้เป็นอันระงับสิ้นไป และไม่ตกทอดไปยังทายาทแต่อย่างใด



ข้อ 4. ในการใช้สิทธิเก็บกินนั้น ผู้รับสัญญาต้องรักษาทรัพย์สินเสมอกับที่วิญญูชนจะพึง

รักษาทรัพย์สินของตนเอง



ข้อ 5. ผู้รับสัญญาจะโอนสิทธิเก็บกินไปให้ผู้อื่น หรือบุคคลภายนอกไม่ได้ เว้นแต่จะได้รับ

ความยินยอมจากผู้ให้สัญญาเป็นลายลักษณ์อักษร



ข้อ 6. ผู้รับสัญญาจะใช้ทรัพย์สินในทางอันมิชอบด้วยกฎหมายไม่ได้



ข้อ 7. ผู้รับสัญญา จำต้องสงวนสถานะแห่งทรัพย์สินมิให้เปลี่ยนไปในสาระสำคัญ กับต้อง

บำรุงรักษาปรกติและซ่อมแซมเล็กน้อยด้วย



ข้อ 8. ผู้รับสัญญาต้องออกค่าใช้จ่ายในการจัดการทรัพย์สิน ตลอดจนค่าภาษีอากรอันเกี่ยว

กับทรัพย์สิน รวมทั้งต้องใช้ดอกเบี้ยหนี้สิน ซึ่งติดพันทรัพย์สินนั้น



ข้อ 9. ผู้รับสัญญาต้องเอาทรัพย์สินประกันวินาศภัยเพื่อประโยชน์แก่ผู้ให้สัญญา ตลอดระยะ

เวลาแห่งสัญญานี้ โดยผู้รับสัญญาเป็นผู้เสียเบี้ยประกันภัย



ข้อ 10. ในกรณีที่คู่สัญญาฝ่ายใดฝ่ายหนึ่งประพฤติผิดสัญญาข้อใดข้อหนึ่ง คู่สัญญาอีกฝ่าย

หนึ่งมีสิทธิเลิกสัญญาได้



หนังสือสัญญาฉบับนี้ทำขึ้นเป็นสองฉบับมีข้อความถูกต้องตรงกัน ทั้งสองฝ่ายได้อ่านและเข้าใจ

ข้อความในสัญญาโดยตลอดแล้ว จึงลงลายมือชื่อไว้เป็นสำคัญต่อหน้าพยาน
