โดยคดีดังกล่าวได้ยื่นฟ้องต่อศาลปกครองพิษณุโลก มาตั้งแต่วันที่ 11 ธันวาคม 2552 หลังจากที่หน่วยงานภาครัฐที่ถูกฟ้องคดีดังกล่าวปล่อยปละละเลย และใช้อำนาจอนุญาตให้มีเหมืองแร่สังกะสี ในบริเวณพื้นที่ต้นน้ำของชาวบ้าน จนทำให้เกิดการแพร่กระจายของสารแคดเมียม กระจายไปในพื้นที่นาข้าวของชาวบ้านใน 3 ตำบล คือ ต.แม่ตาว ต.แม่กุ และ ต.พระธาตุผาแดง อ.แม่สอด จ.ตาก ทำให้ผลผลิตนาข้าวของชาวบ้านปนเปื้อนด้วยสารแคดเมียม จนไม่สามารถทำนาได้ตามปกติ

ทั้งนี้ กลุ่มชาวบ้านที่ได้รับผลกระทบจาก 3 ตำบลใน อ.แม่สอด ประมาณ 100 คน ได้เดินทางมารับฟังคำพิพากษา พร้อมกับ นายนายศรีสุวรรณ จรรยา นายกสมาคมต่อต้านสภาวะโลกร้อนและสภาทนายความ จากนั้นศาลปกครองพิษณุโลกใช้เวลาอ่านคำพิพากษา ตั้งแต่เวลา 09.30-10.15 น. ได้อ่านคำพิพากษา ระบุว่า ให้จำเลยที่ 1 คณะกรรมการสิ่งแวดล้อมแห่งชาติ ดำเนินการกำหนดให้พื้นที่ลุ่มน้ำแม่ตาว อ.แม่สอด จ.ตาก เป็นเขตพื้นที่คุ้มครองสิ่งแวดล้อม ภายใน 90 วัน นับแต่คดีถึงที่สุด ส่วนคำขอกรณีอื่นนั้นให้ยก ทั้งนี้ คำพิพากษาของศาลปกครองพิษณุโลกเป็นคำพิพากษาชั้นต้น ฝ่ายจำเลยสามารถใช้สิทธิ์ยื่นอุทธรณ์ได้ภายใน 30 วัน
