หากผู้ให้เช่าไม่สามารถดำเนินการติดตั้ง และส่งมอบระบบเครือข่ายและอุปกรณ์ให้แล้วเสร็จตามเวลาที่กำหนดไว้ในแผนการติดตั้ง และผู้เช่ามิได้บอกเลิกสัญญา ผู้ให้เช่าจะต้องชำระค่าปรับให้แก่ผู้เช่าเป็นรายวันในอัตรา
ร้อยละ 0.2 (ศูนย์จุดสอง) ของวงเงินค่าเช่าใช้ตามสัญญาต่อปี นับถัดจากวันที่ครบกำหนดส่งมอบ หรือวันที่ผู้เช่าได้ขยายให้ จนถึงวันที่ผู้ให้เช่า ได้ส่งมอบระบบเครือข่ายและอุปกรณ์ให้แก่ผู้ให้เช่าครบถ้วน นอกจากนี้ผู้ให้เช่ายอมให้ผู้เช่าเรียกค่าเสียหายที่เกิดขึ้นจากการที่ผู้ให้เช่าทำงานล่าช้าเฉพาะส่วนที่เกินกว่าจำนวนค่าปรับและค่าใช้จ่ายดังกล่าวได้อีกด้วย
