โดยศาลอ่านและอธิบายคำฟ้องให้จำเลยทั้งสองฟังแล้วสอบคำให้การ ปรากฏว่า นายเสฏฐวุฒิ จำเลยที่ 1ให้การรับสารภาพ ส่วนนายบุญธรรม จำเลยที่ 2 ให้การปฏิเสธ ต่อสู้คดี

ศาลจึงพิพากษาเฉพาะในส่วนของนายเสฏฐวุฒิ จำเลยที่ 1 ว่ากระทำผิดจริง ตาม ม.112 ให้จำคุก 5 ปี คำรับสารภาพเป็นประโยชน์แก่การพิจารณา ลดโทษกึ่งหนึ่ง จึงจำคุก 2 ปี 6 เดือน

ส่วนนายบุญธรรม จำเลยที่ 2 ที่ให้การปฏิเสธสู้คดีนั้น ศาลให้จำหน่ายคดีออกจากสารบบความชั่วคราว เพื่อให้พนักงานอัยการโจทก์ ยื่นฟ้องคดีนายบุญธรรม เข้ามาใหม่ภายใน 7 วัน ตามกฎหมาย

ภายหลังเสร็จสิ้นกระบวนพิจารณาแล้ว เจ้าหน้าที่ราชทัณฑ์ ก็ได้นำตัวจำเลยทั้งสอง ไปคุมขังที่เรือนจำพิเศษกรุงเทพฯ โดยตลอดระยะเวลาการพิจารณาคดีในศาล จำเลยทั้งสองก็ไม่เคยได้รับการปล่อยชั่วคราวแต่อย่างใด
