สิทธิมนุษยชน (Human Right) หมายถึง

สิทธิมนุษยชน (Human Right) หมายถึง สิทธิที่มนุษย์ทุกคนมีความเท่าเทียมกัน มีศักดิ์ศรีของความเป็นมนุษย์ สิทธิ เสรีภาพ และความเสมอภาคของบุคคลที่ได้รับการรับรอง ทั้งความคิดและการกระทำที่ไม่มีการล่วงละเมิดได้ โดยได้รับการ คุ้มครองตามรัฐธรรมนูญแห่งราชอาณาจักรไทย และสนธิสัญญาระหว่างประเทศ

1. ศักดิ์ศรีความเป็นมนุษย์ (Human Dignity) หมายถึง คุณสมบัติ จิตใจ สิทธิเฉพาะตัวที่พึงสงวนของมนุษย์ทุกคน และรักษาไว้มิให้บุคคลอื่นมาล่วงละเมิดได้ การถูกละเมิดศักดิ์ศรีความเป็นมนุษย์จึงเป็นสิ่งที่ต้องได้รับการคุ้มครองและได้รับความยุติธรรมจากรัฐ

2. สาเหตุที่มนุษย์ต้องได้รับความคุ้มครองสิทธิมนุษยชน เกิดจาก

3. หลักการสำคัญที่สุดของสิทธิมนุษยชน คือ มนุษย์ทุกคนมีศักดิ์ศรีของความเป็นมนุษย์เท่าเทียมกัน รัฐธรรมนูญแห่งราชอาณาจักรไทย พุทธศักราช 2550 ได้รับรองศักดิ์ศรีความเป็นมนุษย์ไว้ และกำหนดให้รัฐบาล ส่วนราชการ หน่วยงานของรัฐดำเนินการปฏิบัติงานตามอำนาจหน้าที่โดยคำนึงถึงศักดิ์ศรีความเป็นมนุษย์ของประชาชนทุกคน

4. การคุ้มครองสิทธิมนุษยชนในประเทศไทย

1. สังคมไทยเป็นสังคมที่ต่างเชื้อชาติ ศาสนา เผ่าพันธุ์ สามารถดำรงชีวิตอยู่ร่วมกันอย่างสันติ จนกลมกลืนเป็นหนึ่งเดียวในความเป็นไทยโดยไม่มีการแตกแยก ยอมรับความหลากหลาย มีจิตใจเอื้อเฟื้อเกื้อกูลกัน จึงไม่มีการละเมิดสิทธิมนุษยชนในเรื่องการแบ่งชนชั้น หรือเผ่าพันธุ์ แต่การละเมิดสิทธิมนุษยชนก็ยังปรากฏอย่างต่อเนื่อง เช่น การละเมิดสิทธิเด็ก เช่น การละเมิดทางเพศ แรงงาน ยาเสพติด อบายมุข ความรุนแรงในการลงโทษ การละเมิดสิทธิสตรี ในสังคมไทยยังปรากฏการใช้ความรุนแรงต่อผู้หญิงในครองครัว ความรุนแรงทางเพศในที่สาธารณะ ที่บ้าน ที่ทำงาน สถานกักกัน การล่อลวงทางอินเตอร์เน็ต โรงภาพยนตร์ บนรถเมล์

2. การเข้ามามีส่วนร่วมในการคุ้มครองสิทธิมนุษยชน บุคคลควรมีส่วนร่วมในการคุ้มครองสิทธิมนุษยชนใน สังคมไทยต่อไปนี้

1. ศึกษาเรื่องสิทธิมนุษยชนในสังคมไทยที่พัฒนาความรู้ ทักษะ ค่านิยมในการคุ้มครองสิทธิมนุษยชน

องค์กรที่เกี่ยวข้องกับสิทธิมนุษยชนในประเทศไทย มีดังนี้

องค์กรสิทธิมนุษยชน ระดับโลก

1. คณะกรรมการสิทธิมนุษยชนแห่งสหประชาชาติ 2. กองทุนสงเคราะห์เด็กแห่งสหประชาชาติ หรือ ยูนิเซฟ (UNICEF)

ศาลในปัจจุบันจึงมีบทบาทในการให้ความยุติธรรมในด้านสิทธิมนุษยชน เช่น

4. การจัดและคุมขังบุคคลใด ๆ ในคดีอาญาจะกระทำได้ก็ต่อเมื่อมีคำสั่งหรือหมายศาล ยกเว้นการกระทำผิดซึ่งหน้า

5. สิทธิของผู้ต้องหาในการให้ทนายความหรือผู้ซึ่งตนไว้วางใจเข้าฟังการสอบปากคำตนได้

ปฏิญญาสากลว่าด้วยสิทธิมนุษยชนแห่งสหประชาชาติ

วันที่ 10 ธันวาคม ค.ศ.1948 ประเทศสมาชิกสหประชาชาติได้รับรองปฏิญญาสากลว่าด้วยสิทธิมนุษยชน (Universal Declaration of Human Right: UDHR) โดยสมัชชาแห่งสหประชาชาติ ถือเป็นการกำหนดมาตรฐานสากลด้านสิทธิมนุษยชนซึ่งไทยเป็นประเทศหนึ่งที่ร่วมกับประเทศต่าง ๆ ให้การรับรองปฏิญญาสากลว่าด้วยสิทธิมนุษยชนแห่งสหประชาชาติ
