พล.ต.ท.ไถง กล่าวผ่านหนังสือพิมพ์มติชนว่า ผู้ต้องหาให้การปฏิเสธว่าไม่ได้ส่งข้อความตามที่ถูกกล่าวหา แต่ยอมรับว่า โทรศัพท์ทั้งหมดเป็นของตนจริง แต่ได้เลิกใช้ไปนานแล้ว ทั้งนี้ผู้ต้องหาไม่มีอาชีพเป็นหลักแหล่ง จึงไม่เชื่อว่าจะทราบเบอร์โทรศัพท์มือถือของบุคคลสำคัญของประเทศและส่ง ข้อความที่ไม่เหมาะสมได้ จึงเชื่อว่าจะมีผู้สนับสนุนหรืออยู่เบื้องหลัง และยังเชื่อว่าจำเลยเป็นฮาร์ดคอร์กลุ่มคนเสื้อแดง จ.สมุทรปราการ ที่ กอ.รมน. ขึ้นบัญชีดำไว้ด้วย

จำเลยถูกจับกุมโดยไม่ได้รับการประกันตัวเป็นเวลา 63 วัน จากนั้นในวันที่ 29 ก.ย.53 ทนายความยื่นประกันตัวครั้งที่สอง โดยใช้ที่ดินของญาติเป็นหลักทรัพย์ และเมื่อวันที่ 4 ต.ค.53 ศาลอุทธรณ์อนุญาตให้ประกันตัว โดยให้เหตุผลว่า หลักประกันน่าเชื่อถือได้ว่าจำเลยจะไม่หลบหนี
