เดิมกฎหมายของประเทศไทยนั้นมีที่มาจากจารีตประเภณี ศาสนา รวมไปถึงพระราชโองการของพระมหากษัตริย์ ในสมัยกรุงศรีอยุธยามีกฎหมายที่เรียกว่า “พระราชศาสตร์” ซึ่งพระมหากษัตริย์ทรงตราขึ้นโดยอาศัยหลักใน “คัมภีร์พระธรรมศาสตร์” จนกระทั่งการเสียเมืองครั้งที่ 2 ให้แก่ประเทศพม่า เอกสารสำคัญทางกฎหมายได้มีการถูกทำลายและสูญหายไปเป็นจำนวนมาก ต่อมาในสมัยของรัชการที่ 1 แห่งกรุงรัตนโกสินทร์ แม้จะมีการรวบรวมกฎหมายขึ้นใหม่แต่ก็เหลือเพียงหนึ่งในสิบของกฎหมายที่มีอยู่เดิมในสมัยกรุงศรีอยุธยา อีกทั้งยังมีเนื้อหาที่ผิดเพี้ยนไปจากเดิม ทำให้กฎหมายที่มีอยู่ไม่สามารถตัดสินคดีได้อย่างยุติธรรม รัชกาลที่ 1 จึงทรงชำระสะสางกฎหมายเสียใหม่กลายเป็น “กฎหมายตราสามดวง” ถือเป็นกฎหมายที่มีความสำคัญของไทยเรา นักวิชาการทั้งหลายถือว่าแม้จริงแล้วกฎหมายตราสามดวงนี้ก็คือกฎหมายในสมัยกรุงศรีอยุธยานั่นเอง

คดีสำคัญที่ก่อให้เกิดกฎหมายตราสามดวงก็คือ “คดีอำแดงป้อม” (อำแดง เป็นคำนำหน้าชื่อของผู้หญิงในสมัยก่อน) คดีนี้มีข้อเท็จจริงคือ นายบุญศรี ช่างเหล็กหลวง ได้ร้องทุกข์กล่าวโทษพระเกษมและนายราชาอรรถ เนื่องจาก อำแดงป้อม ภรรยาของนายบุญศรีเป็นชู้กับ นายราชาอรรถ แต่อำแดงป้อมกลับมาฟ้องหย่านายบุญศรี นายบุญศรีไม่ยอมหย่า แต่พระเกษมกลับพิจารณาเข้าข้างอำแดงป้อมแล้วคัดข้อความส่งให้ลูกขุน ณ ศาลหลวง มีคำตัดสินให้อำแดงป้อมกับนายบุญศรีขาดจากการเป็นสามีภรรยาตามกฎหมาย เมื่อรัชการที่ 1 ทรงทราบเรื่องจึงตรัสว่า หญิงนอกใจชายแล้วมาฟ้องหย่า ลูกขุนปรึกษากันแแล้วให้หย่าตามคำฟ้องนั้นไม่เป็นการยุติธรรม จึงมีพระราชโองการตรัสสั่งให้เจ้าพระยาคลังตรวจสอบกฎหมายดังกล่าว ปรากฎได้ความว่า ชายไม่ผิด หญิงมาขอหย่า ก็สามารถหย่าได้(ตามที่บันทึกใช้คำว่า ชายหาผิดมิได้หญิงขอหย่า ท่านว่าเป็นหญิงหย่าชายหย่าได้) จึงทรงเห็นว่าแม้แต่พระไตรปิฎกผิดเพี้ยนไป ก็ยังอาราธนาพระราชาคณะทั้งปวงให้ทำสังคายนาชำระพระไตรปิฎกให้ถูกต้องได้ ดังนั้นเมื่อกฎหมายผิดเพี้ยนไปก็ควรต้องชำระสะสางให้ถูกต้อง พระองค์จึงทรงพระกรุณาโปรดเกล้าโปรกกระหม่อมตั้งคณะกรรมการขึ้นมา ประกอบด้วยอาลักษณ์ 4 ลูกขุน 3 ราชบัณฑิต 4 จัดการชำระบทกฎหมายให้ถูกต้อง โดยอาศัย “คัมภีร์พระธรรมศาสตร์”(เชื่อกันว่าเป็นคัมภีร์ที่ผู้ทรงอิทธิฤทธิ์ หรือผู้มีอำนาจเหนือคนธรรมดาแต่งขึ้น เดิมนั้นเป็นของชาวฮินดู เป็นหนังสือในศาสนาพราห์ม) เป็นหลักในการบัญญัติกฎหมาย เช่นเดียวกับในสมัยกรุงศรีอยุธยา เกิดเป็นกฎหมายตราสามดวงขึ้น
