จากกรณีที่นายวิรัตน์ กัลยาศิริ อดีต ส.ส.พรรคประชาธิปัตย์ ได้ไปยื่นคำร้องขอต่อศาลรัฐธรรมนูญเพื่อวินิจฉัยว่า การเลือกตั้งเมื่อวันที่ 2 ก.พ. 2557 เป็นโมฆะ เนื่องจากขัดต่อรัฐธรรมนูญมาตรา 68 รวมทั้งมีนักกฎหมายหลายคนออกมาให้ความเห็นว่า การเลือกตั้งครั้งนี้เข้าข่ายเป็นโมฆะ เพราะไม่ได้ดำเนินการให้เสร็จสิ้นในวันเดียวตามรัฐธรรมนูญ มาตรา 108 นั้น
