หนังสือฉบับนี้ทำขึ้นระหว่าง
นายชาญชัย เชี่ยวชาญพัฒนากร อยู่บ้านเลขที่ 593 ถนนพระราม 4 แขวงรองเมือง เขตปทุมวัน จังหวัดกรุงเทพมหานคร ซึ่งต่อไปในหนังสือฉบับนี้จะเรียกว่า “ผู้ให้ความยินยอม” ฝ่ายหนึ่ง กับ
บริษัท สวนทรายงาม จำกัด สำนักงานอยู่บ้านเลขที่ 82/3 หมู่ที่ 3 ตำบลปากคลอง อำเภอปะทิว จังหวัดชุมพร ซึ่งต่อไปในหนังสือฉบับนี้จะนี้เรียกว่า “ผู้รับความยินยอม” อีกฝ่ายหนึ่ง
โดยที่ ผู้ให้ความยินยอมเป็นเจ้าของกรรมสิทธิ์ในที่ดิน ซึ่งตั้งอยู่ตามโฉนดที่ดินเลขที่ 22370 ตำบลปากคลอง อำเภอปะทิว จังหวัดชุมพร ปรากฏตามสำเนาโฉนดที่ดิน เอกสารแนบท้ายหมายเลข 1 ซึ่งต่อไปในหนังสือฉบับนี้จะเรียกว่า “ที่ดิน” และผู้รับความยินยอมประสงค์จะขอทำประโยชน์บนที่ดิน ทั้งสองฝ่ายจึงได้ตกลงทำหนังสือฉบับนี้ขึ้นมา โดยมีข้อความดังต่อไปนี้
ข้อ 1. ผู้ให้ความยินยอมตกลงให้ผู้รับความยินยอม มีสิทธิใช้ประโยชน์บนที่ดิน เพื่อศึกษาพืชพลังงาน ปรากฏตามสำเนาแผนที่แสดงพื้นที่ขอใช้ประโยชน์ เอกสารแนบท้ายหมายเลข 2 ซึ่งต่อไปในหนังสือฉบับนี้จะเรียกว่า “พื้นที่” โดยทั้งสองฝ่ายตกลงให้ถือว่าเป็นส่วนหนึ่งของหนังสือยินยอมให้ใช้ประโยชน์บนที่ดิน
ข้อ 2. การยินยอมตามหนังสือฉบับนี้มีกำหนดระยะเวลา 2 ปี 7 เดือน โดยเริ่มตั้งแต่วันที่ 1 มกราคม 2559 ถึงวันที่ 31 กรกฎาคม 2561
ข้อ 3. ผู้รับความยินยอมตกลงที่จะไม่ขยายการทำประโยชน์ไปยังบริเวณอื่น ๆ ของที่ดิน นอกจากพื้นที่ตามที่ระบุไว้ในข้อ 1. เท่านั้น
ข้อ 4. ผู้รับความยินยอมตกลงให้ผู้ให้ความยินยอม หรือตัวแทนเข้าตรวจดูที่ดินได้
ข้อ 5. ผู้รับความยินยอมจะโอนสิทธิตามสัญญานี้ให้แก่ผู้อื่น หรือบุคคลภายนอกไม่ได้
ข้อ 6. ผู้รับความยินยอมตกลงที่จะดูแล รักษา และปรับปรุงที่ดิน และที่ดินที่เป็นกรรมสิทธิ์ของผู้ให้ความยินยอมที่อยู่ข้างเคียงโดยรอบ รวมตลอดถึงทรัพย์สินอื่น ๆ ที่อยู่ภายในบริเวณที่ดินและบริเวณโดยรอบที่ดิน เช่น รั้ว ต้นไม้ ทั้งที่มีอยู่ในปัจจุบัน และที่จะมีขึ้นต่อไปในอนาคตให้อยู่ในสภาพที่ดี ไม่ปล่อยให้รกร้าง และมิ

ข้อ 7. ในอนาคตหากผู้ให้ความยินยอมมีความประสงค์จะใช้ที่ดิน เมื่อผู้ให้ความยินยอมได้แจ้งให้ผู้รับความยินยอมทราบล่วงหน้า ผู้รับความยินยอมตกลงรื้อถอนสิ่งปลูกสร้างใดๆ และส่งมอบที่ดินในสภาพเรียบร้อยคืนให้แก่ผู้ให้ความยินยอม ภายในกำหนด 30 วันนับแต่ได้รับแจ้ง
ข้อ 8. หากผู้รับความยินยอมไม่ปฏิบัติตามข้อหนึ่งข้อใดหรือทั้งหมดของหนังสือฉบับนี้
ผู้ให้ความยินยอมมีสิทธิบอกเลิกหนังสือฉบับนี้ได้ทันที โดยผู้รับความยินยอมต้องรื้อถอนสิ่งปลูกสร้างใด ๆ และส่งมอบที่ดินในสภาพเรียบร้อยคืนให้แก่ผู้ให้ความยินยอมทันที และผู้รับความยินยอมตกลงยินยอมที่จะชดใช้ค่าเสียหาย (ถ้ามี) จากการไม่ปฏิบัติตามหนังสือฉบับนี้ให้แก่ผู้ให้ความยินยอม
หนังสือฉบับนี้ ทำขึ้นเป็นสองฉบับ มีข้อความถูกต้องตรงกัน ทั้งสองฝ่ายได้อ่านและเข้าใจข้อความแล้ว จึงลงลายมือชื่อไว้เป็นหลักฐานต่อหน้าพยาน
