กฎหมายสำคัญของไทยที่เกี่ยวกับอุตสาหกรรมการท่องเที่ยว แบ่งออกเป็น 4 กลุ่ม ดังนี้
1.กฎหมายเกี่ยวกับองค์การที่ดูแลสนับสนุนการท่องเที่ยวโดยทั่วไป
มีกฎหมายสำคัญจำนวน 4 ฉบับ ได้แก่
1.พระราชบัญญัติการท่องเที่ยวแห่งประเทศไทย พ.ศ.2522

- กฎหมายก่อตั้งกระทรวงการท่องเที่ยวและกีฬาขึ้นรับผิดชอบด้านการท่องเที่ยว
- ให้การท่องเที่ยวแห่งประเทศไทย (ททท.) โอนภาระงานด้านการพัฒนาแหล่งท่องเที่ยว พัฒนาบริการท่องเที่ยว และทะเบียนธุรกิจนำเที่ยวให้กับกระทรวงการท่องเที่ยวและกีฬา
- ทำให้ททท.มีหน้าที่เพียงด้านการบริหารจัดการตลาดการท่องเที่ยวเป็นหลัก
3.พระราชบัญญัติสภาอุตสาหกรรมการท่องเที่ยวแห่งประเทศไทย พ.ศ.2544
- กำหนดให้มีการจัดตั้งสภาอุตสาหกรรมการท่องเที่ยวแห่งประเทศไทยมี
วัตถุประสงค์เพื่อ
1)เป็นตัวแทนของผู้ประกอบอุตสาหกรรมท่องเที่ยวในด้านการประสานงาน
2)ส่งเสริมการพัฒนาอุตสาหกรรมท่องเที่ยว
3)ส่งเสริมให้มีการอนุรักษ์ศิลปะ วัฒนธรรม ประเพณี สถานที่ท่องเที่ยว โบราณสถาน และสิ่งแวดล้อมรวมทั้งเอกลักษณ์ของความเป็นไทย
4)ส่งเสริมให้มีจรรยามารยาทในการท่องเที่ยว
4.พระราชบัญญัติสภาตำบลและองค์การบริหารส่วนตำบล พ.ศ.2537 ถึง 2546 (รวม 5 ฉบับ)
- เกี่ยวข้องกับการพัฒนาตำบลทั้งในด้านเศรษฐกิจ สังคมและวัฒนธรรม
- จัดให้มีและบำรุงรักษาทางน้ำและทางบก การกำจัดมูลฝอยและสิ่งปฏิกูล ป้องกันโรคและระงับโรคติดต่อ ป้องกันและบรรเทาสาธารณภัย ส่งเสริมการศึกษา ศาสนาและวัฒนธรรม ส่งเสริมการพัฒนาสตรี เด็ก เยาวชน ผู้สูงอายุและผู้พิการ
- คุ้มครองดูแลและบำรุงรักษาทรัพยากรธรรมชาติและสิ่งแวดล้อม
- บำรุงรักษาศิลปะ จารีตประเพณี ภูมิปัญญาท้องถิ่น และวัฒนธรรมอันดีของท้องถิ่น

2. กฎหมายควบคุมนักท่องเที่ยว มีกฎหมายสำคัญ จำนวน 2 ฉบับ ได้แก่
1.พระราชบัญญัติคนเข้าเมือง พ.ศ.2522, 2523 และ 2542
- เป็นกฎหมายที่เกี่ยวข้องกับการอนุญาตให้ชาวต่างชาติเดินทางเข้าออกในประเทศไทยในฐานะนักท่องเที่ยว
- ดูแลเกี่ยวกับการเข้ามาในราชอาณาจักรเป็นการชั่วคราวของคนต่างด้าว
- การควบคุมพาหนะที่เข้า-ออกประเทศตามช่องทางด่านตรวจคนเข้าเมืองหรือท้องที่ที่กำหนด
2.พระราชบัญญัติศุลกากร พ.ศ.2469 ถึง 2548
- เป็นกฎหมายเก่าแก่ที่ใช้มาตั้งแต่ พ.ศ. 2469 และได้มีการแก้ไขเพิ่มเติมเรื่อยมาโดยลำดับ
- ในปัจจุบัน (พ.ศ. 2548) มีกฎหมายศุลกากรใช้บังคับอยู่รวม 20 ฉบับ
- เนื้อหาเกี่ยวข้องกับการนำของเข้า การส่งของออก การเสียภาษีตามพิกัดอัตราศุลกากรของนักท่องเที่ยว รวมทั้งระเบียบว่าด้วยการตรวจของและป้องกันการลักลอบหนีศุลกากร และข้อกำหนดเรื่องการนำเงินตราเข้าออกประเทศ

3. กฎหมายควบคุมดูแลและพัฒนาทรัพยากรการท่องเที่ยว
มีกฎหมายสำคัญ จำนวน 17 ฉบับ ได้แก่
1)พระราชบัญญัติอุทยานแห่งชาติ พ.ศ.2504
- เป็นกฎหมายที่เกี่ยวข้องกับการคุ้มครองดูแลรักษาและจัดการอุทยานแห่งชาติอันเป็นทรัพยากรการท่องเที่ยวประเภทธรรมชาติซึ่งต้องการให้มีการจัดการ การอนุรักษ์ และพัฒนาให้เป็นแหล่งท่องเที่ยวที่มีความยั่งยืน
- อยู่ภายใต้การบริหารจัดการของกรมอุทยานแห่งชาติ สัตว์ป่า และพันธุ์พืช กระทรวงทรัพยากรธรรมชาติและสิ่งแวดล้อม
2)พระราชบัญญัติสงวนและคุ้มครองสัตว์ป่า พ.ศ.2535 และ 2546
- เกี่ยวข้องกับการสงวนและคุ้มครองสัตว์ป่าโดยคณะกรรรมการสงวนและคุ้มครองสัตว์ป่าแห่งชาติ เพื่อไม่ให้สัตว์ป่าเหล่านั้นถูกทำร้ายและสูญพันธุ์ในบริเวณเขตอนุรักษ์พันธุ์สัตว์ป่า และอุทยานแห่งชาติ
- กิจกรรมการดูนก ส่องสัตว์ในบริเวณดังกล่าว สำหรับนักท่องเที่ยวจึงมีความจำเป็นและเกี่ยวโยงกับอุตสาหกรรมท่องเที่ยวอย่างหลีกเลี่ยงไม่ได้
3)พระราชบัญญัติป่าสงวนแห่งชาติ พ.ศ.2507, 2522 และ 2528
-เกี่ยวข้องกับการจัดการดูแลพื้นที่บริเวณที่เป็นป่าสงวน
-ซึ่งปัจจุบันสถานที่ท่องเที่ยวในหลายพื้นที่ยังคงอยู่ในอำนาจหน้าที่ของพระราชบัญญัติป่าสงวนแห่งชาติ

4.พระราชบัญญัติป่าไม้ พ.ศ. 2484, 2522 และ 2525
- เกี่ยวกับการพัฒนาและอนุรักษ์ทรัพยากรการท่องเที่ยวประเภทธรรมชาติ
- ควบคุมการตัดไม้ ทำไม้ และของป่าหวงห้าม รวมทั้งควบคุมการนำไม้และของป่าเคลื่อนออกจากป่า
- เพื่อมิให้มีการตัดไม้และทำลายไม้โดยไม่จำเป็น และสงวนไม้มีค่าบางชนิดเอาไว้
- มีส่วนช่วยในการอนุรักษ์สภาพแวดล้อมของป่าให้ยั่งยืน
5)พระราชบัญญัติแร่ พ.ศ. 2510, 2522 และ 2534
- การสำรวจแร่หรือทำเหมือง ถ้าพบโบราณวัตถุหรือซากดึกดำบรรพ์หรือแร่พิเศษอันมีคุณค่าแก่การศึกษาในทางธรณีวิทยา จะต้องปฏิบัติตามบทบัญญัติแห่งกฎหมายเกี่ยวกับการเก็บได้ซึ่งวัตถุนั้น และผู้ถืออาชญาบัตรหรือผู้ถือประทานบัตรชั่วคราว หรือผู้ถือประทานบัตรจะต้องแจ้งต่อทรัพยากรธรณีประจำท้องถิ่น

7)พระราชบัญญัติวัฒนธรรมแห่งชาติ พ.ศ.2485 เป็นกฎหมายที่เกี่ยวข้องกับการรักษาและอนุรักษ์ประเพณีและศิลปวัฒนธรรม ความเป็นเอกลักษณ์ของชาติให้คงอยู่สืบไปซึ่งกิจกรรมประเพณีและศิลปวัฒนธรรมจัดเป็นสินค้าทางการท่องเที่ยวที่สำคัญ การดำเนินการใดๆ ที่เกี่ยวข้องกับศิลปวัฒนธรรมเพื่อการท่องเที่ยวจึงจำเป็นต้องปฏิบัติตามพระราชบัญญัติวัฒนธรรมแห่งชาติ
