Immigration New Zealand Instructions E7.35 state that if an immigration officer is not satisfied that an applicant has met all of the requirements of the relevant immigration instructions for temporary entry, and that an exception to instructions is not justified, the officer must decline the application.

We consider this course is seen to facilitate your entry to New Zealand.

It is noted that you are a business owner and have provided a copy of your business registration with this application. Apart from a copy of business registration, there is no other evidence provided to demonstrate the stability of your business and or explanation of how your business will be continued during your away. We therefore are unable to be convinced that your business is deemed to be strong enough ties to encourage your return. Having reviewed your overall circumstances in conjunction with evidence provided, we are not satisfied that you are a bona fide applicant to New Zealand with sufficient ties to encourage your return to after the intended visit. We are concerned that if permitted to travel, your personal circumstances in home country may prevent you from departing New Zealand by the expiry of your visa. We further have concerned that you would abide by the visa condition if permitted you to travel to New Zealand.

We have considered whether the imposition of a bond or the granting of a limited visa would mitigate our concerns but we do not think that they would. We have also considered whether there are any special circumstances which would warrant an exception to immigration instructions but we can find no reason to grant a visa as an exception.

Please note that you have no statutory right of appeal, or right of reconsideration of our decisions. However, you do have the right to apply again for a New Zealand visa at any time. We will consider any future applications on their merits under immigration instruction applicable at that time. However, if there are no changes in your circumstances, your application is unlikely to be approved.
