พุทธศักราช ๒๔๘๐

โดยที่สภาผู้แทนราษฎรลงมติว่า สมควรเพิ่มเติมกฎหมายว่าด้วยการศุลกากร ที่เกี่ยวกับเรื่องนำของเข้าหรือส่งของ
ออกทางบก
จึ่งมีพระบรมราชโองการให้ตราพระราชบัญญัติขึ้นไว้โดยคำแนะนำและยิน ยอมของสภาผู้แทนราษฎร ดั่งต่อไปนี้

มาตรา ๑ พระราชบัญญัตินี้ให้เรียกว่า “พระราชบัญญัติศุลกากร (ฉบับที่ ๗) พุทธศักราช ๒๔๘๐”

มาตรา ๒ ให้ใช้พระราชบัญญัตินี้เมื่อพ้นกำหนดเก้าสิบวันนับแต่วัน ประกาศในราชกิจจานุเบกษาเป็นต้นไป

มาตรา ๓ ในพระราชบัญญัตินี้ เว้นแต่จะมีข้อความแสดงให้เห็นเป็นอย่าง อื่น
“ทางอนุมัติ” ให้หมายความว่า ทางที่กำหนดโดยกฎกระทรวง ให้เป็นทางที่ จะใช้ขนส่งของเข้าในหรือออกนอก
ราชอาณาจักรได้ หรือจากเขตแดนทางบกมายังด่าน ศุลกากร หรือจากด่านศุลกากรไปยังเขตแดนทางบกได้
“ด่านพรมแดน” ให้หมายความว่า ด่านที่ตั้งขึ้นไว้โดยกฎกระทรวง ณ ทาง อนุมัติ เพื่อตรวจของที่ขนส่งโดยทางนั้น

มาตรา ๔ ของใดๆ ที่นำเข้าในหรือส่งออกนอกราชอาณาจักรโดยผ่านเขต แดนใดๆ ทางบกหรือตอนใดแห่งเขตแดนนั้น อาจมีพระราชกฤษฎีกาให้ยกเงินอากรซึ่ง เรียกเก็บตามพระราชบัญญัติพิกัดอัตราศุลกากรที่ใช้อยู่ในเวลาที่นำเข้าหรือส่งออกนั้น ให้ ทั้งหมดหรือแต่ส่วนใดส่วนหนึ่งก็ได้

มาตรา ๕ ห้ามมิให้ผู้ใดขนส่งของหรือพยายามขนส่งของผ่านเขตแดนทาง บกเข้าในหรือออกนอกราชอาณาจักรหรือ
ตั้งแต่ เขตแดนทางบกมายังด่านศุลกากร หรือ จากด่านศุลกากรไปยังเขตแดนนั้นตามทางใดๆ นอกจากทางอนุมัติ หรือในเวลาใดๆ นอกจากเวลาที่อธิบดีกำหนดโดยประกาศในราชกิจจานุเบกษา

อักษรจากอธิบดีหรือผู้แทน และต้องปฏิบัติ ตามเงื่อนไขซึ่งอธิบดีกำหนดขึ้นไว้เป็นพิเศษโดยเฉพาะ
ห้ามมิให้ผู้ใดช่วยเหลือการขนส่งอันต้องห้ามดั่งกล่าวแล้ว หรือเก็บ หรือ ซ่อน หรือยินยอมให้เก็บหรือซ่อน หรือจัดให้เก็บ
หรือซ่อนของใดๆ โดยรู้อยู่แล้วว่าของ นั้นๆ ได้ขนส่งโดยฝ่าฝืนข้อห้ามดั่งกล่าวแล้ว

มาตรา ๖ อธิบดีมีอำนาจประกาศในราชกิจจานุเบกษา ห้ามมิให้ผู้ควบคุม เรือลำใด หรือเรือประเภทใดที่ใช้ขนของส่ง
ตามลำน้ำซึ่งเป็นเขตแดนทางบก จอดเทียบท่า เพื่อขนของขึ้นลงตามลำน้ำนั้น ณ ที่ใดๆ เว้นแต่ที่ซึ่งประกาศไว้

มาตรา ๗ ผู้ขนส่งของอันมิใช่เป็นหีบห่อของส่วนตัวผู้ที่โดยสารในยวดยาน บรรทุกนั้น เมื่อผ่านเขตแดนทางบกเข้า
ไปในราชอาณาจักร ให้ปฏิบัติดั่งต่อไปนี้
(๑) ให้มีบัญชีสินค้าแสดงรายการของทั้งปวงที่ขนส่งตามแบบที่อธิบดี ต้องการเป็นสองฉบับ และยื่นบัญชีนั้นต่อ
พนักงานด่านพรมแดนและด่านศุลกากร และ เมื่อพนักงานด่านพรมแดนได้ลงลายมือชื่อในบัญชีสินค้าฉบับหนึ่งแล้ว ให้ถือว่า
บัญชี ฉบับนั้นเป็นใบอนุญาตให้นำของผ่านด่านพรมแดนมายังด่านศุลกากรได้
(๒) เมื่อได้รับใบอนุญาตผ่านด่านจากพนักงานด่านพรมแดนแล้ว ให้ขน ของมายังด่านศุลกากรโดยพลันตามทางอนุมัติ

มาตรา ๘ ผู้ขนส่งของอันมิใช่เป็นหีบห่อของส่วนตัวผู้ที่โดยสารในยวดยาน ที่บรรทุกนั้น เมื่อจะผ่านเขตแดนทางบก
ออกนอกราชอาณาจักร ให้ปฏิบัติดั่งต่อไปนี้

และเมื่ออธิบดีได้ประกาศสั่งแล้ว ก็ให้ผู้ขนส่งทำ บัญชีเช่นว่านั้นตามแบบที่อธิบดีต้องการเป็นสองฉบับ และยื่นบัญชีนั้นต่อ
พนักงาน ณ ด่านศุลกากรและด่านพรมแดน

มาตรา ๙ ผู้ควบคุมยวดยาน หรือเรือใดๆ ทั้งที่บรรทุก หรือมิได้บรรทุกของ หรือผู้ควบคุมสัตว์พาหนะที่บรรทุก
ของ และบุคคลใดๆ ที่ขนส่งของโดยวิธีใดๆ ทั้งสิ้น เมื่อเข้าในหรือจะออกนอกราชอาณาจักรตามทางอนุมัติ ให้หยุดที่ด่าน
