บทที่ 5
“หลักเกณฑ์การทำงานล่วงเวลาและทำงานในวันหยุด”
นายจ้างอาจ ให้ลูกจ้างทำงานล่วงเวลาในวันทำงาน หรือทำงานในวันหยุดรวมถึงล่วงเวลาในวันหยุดได้เป็นครั้งคราว โดยจะต้องได้รับความยินยอมจากลูกจ้างก่อนเป็นแต่ละคราวไป

5.1 ค่าล่วงเวลา
5.1.1 ถ้าให้ลูกจ้างทำงานเกินเวลาทำงานปกติในวันทำงาน ลูกจ้างจะต้องได้รับค่าล่วงเวลาในอัตรา ดังนี้
ก. ไม่น้อยกว่าหนึ่งเท่าครึ่งของอัตราค่าจ้างต่อชั่วโมงในวันทำงานตามชั่วโมงที่ทำ หรือ
ข. ไม่น้อยกว่าหนึ่งเท่าครึ่งของอัตราค่าจ้างต่อหน่วยในวันทำงานตามจำนวนผลงานที่ทำได้สำหรับลูกจ้างซึ่งได้รับค่าจ้างตามผลงานโดยคำนวณเป็นหน่วย
5.1.2 ถ้าให้ลูกจ้างทำงานในวันหยุดเกินเวลาทำงานของวันทำงาน ลูกจ้างจะได้รับค่าล่วงเวลาในวันหยุดในอัตรา ดังนี้
ก. สามเท่าของอัตราค่าจ้างต่อชั่วโมงในวันทำงานตามชั่วโมงที่ทำ หรือ
ข. สามเท่าของอัตราค่าจ้างต่อหน่วยในวันทำงานตามจำนวนผลงานที่ทำได้สำหรับลูกจ้างซึ่งได้รับค่าจ้างตามผลงานโดยคำนวณเป็นหน่วย

5.2 ค่าทำงานในวันหยุด
