มาตรา ๑๘ ผู้ขอรับใบอนุญาตตามมาตรา ๑๖ และมาตรา ๑๗ ต้องวางหลักประกัน ซึ่งได้แก่ เงินสด หนังสือค้ำประกันของธนาคาร พันธบัตรรัฐบาลไทยหรือพันธบัตรรัฐวิสาหกิจที่รัฐบาลไทยค้ำประกันต้นเงินและดอกเบี้ยอย่างใดอย่างหนึ่งหรือหลายอย่างรวมกันต่อนายทะเบียน เพื่อเป็นหลักประกันการปฏิบัติตามพระราชบัญญัตินี้ ทั้งนี้ ตามจำนวนเงินที่กำหนดในกฎกระทรวง
มาตรา ๑๙ เมื่อมีผู้ยื่นคำขอรับใบอนุญาตประกอบธุรกิจนำเที่ยว ให้เป็นหน้าที่ของนายทะเบียนหรือผู้ซึ่งนายทะเบียนมอบหมายตรวจสอบความครบถ้วนของเอกสารหลักฐานและการปฏิบัติตามหลักเกณฑ์และวิธีการที่กำหนดในกฎกระทรวงที่ออกตามมาตรา ๑๕ วรรคสอง ในกรณีที่พบว่าเอกสารหรือหลักฐานใดไม่ครบถ้วนหรือยังมิได้ปฏิบัติให้ถูกต้อง ให้แจ้งให้ผู้ยื่นคำขอรับใบอนุญาตประกอบธุรกิจนำเที่ยวทราบทันที
มาตรา ๒๐ เมื่อนายทะเบียนพิจารณาเห็นว่าผู้ยื่นคำขอรับใบอนุญาตประกอบธุรกิจนำเที่ยว มีคุณสมบัติและไม่มีลักษณะต้องห้ามตามมาตรา ๑๖ หรือมาตรา ๑๗ แล้วแต่กรณี และได้ปฏิบัติตามหลักเกณฑ์และวิธีการเกี่ยวกับการขอรับใบอนุญาตประกอบธุรกิจนำเที่ยวแล้ว ให้นายทะเบียนมีหนังสือแจ้งให้ผู้ยื่นคำขอรับใบอนุญาตประกอบธุรกิจนำเที่ยวทราบภายในสามสิบวันนับแต่วันที่ได้รับคำขอรับใบอนุญาต ในหนังสือแจ้งนั้นให้แจ้งค่าธรรมเนียมใบอนุญาตประกอบธุรกิจนำเที่ยวและหลักประกันที่ต้องวางไว้ด้วย
