ข้อ ๑๙. กรณีผู้ให้เช่าผิดสัญญา
ในกรณีผู้ให้เช่าผิดสัญญาไม่ว่าข้อใดข้อหนึ่ง หรือหลายข้อรวมกัน ผู้เช่ามีสิทธิที่จะบอกกล่าวให้ผู้ให้เช่าปฏิบัติตามสัญญาภายในกำหนดเวลาที่ผู้เช่าเห็นสมควร หรือเรียกค่าเสียหาย หรือบอกเลิกสัญญา โดยบอกกล่าวล่วงหน้าไม่น้อยกว่า ๒ เดือน ( สองเดือน ) เพื่อให้ผู้ให้เช่าทราบ และให้ถือว่าสัญญาเลิกกันในทันที หรือฟ้องร้องขอให้ศาลมีคำสั่งให้ผู้ให้เช่าปฏิบัติตามสัญญาต่อไป หรือผู้เช่าจะเลือกใช้สิทธิอย่างใดอย่างหนึ่ง หรือเลือกใช้สิทธิดังกล่าวรวมกันก็ได้
ข้อ ๒๐. กรณีสัญญาเลิกกัน
ในกรณีที่สัญญาเลิกกันไม่ว่าจะด้วยเหตุครบกำหนดระยะเวลาการเช่า หรือด้วยเหตุหนึ่งเหตุใดก็ตาม ผู้เช่าตกลงให้บรรดาอาคาร หรือสิ่งปลูกสร้างที่ผู้เช่าได้ก่อสร้างขึ้นมาในที่ดินซึ่งเป็นทรัพย์ที่เช่าตกเป็นกรรมสิทธิ์ของผู้เช่าในทันที และผู้เช่าต้องขนย้ายสิ่งปลูกสร้างที่ได้ก่อสร้างขึ้นมาบนทรัพย์ที่เช่า ขนย้ายบุคคล และทรัพย์สินของผู้เช่าออกจากทรัพย์ที่เช่า และส่งคืนทรัพย์ที่เช่าให้แก่ผู้ให้เช่าในสภาพสะอาดเรียบร้อย ภายในเวลา ๒ เดือน ( สองเดือน ) นับจากสัญญาเลิกกัน และหากผู้เช่าไม่สามารถคืนทรัพย์ที่เช่าได้ภายในเวลาดังกล่าว ผู้เช่ายินยอมชดใช้ค่าเสียหายนับจากวันเลิกสัญญาถึงวันส่งคืนทรัพย์ที่เช่าในสภาพสะอาดเรียบร้อย ในอัตราวันละ...........................บาท (..................................................)
หากครบกำหนดระยะเวลาตามวรรคแรกแล้ว ผู้เช่ายังไม่ได้ส่งมอบทรัพย์ที่เช่า หรือยังไม่ได้ขนย้ายสิ่งปลูกสร้าง ขนย้ายย้ายบุคคล หรือทรัพย์ให้เสร็จสิ้น หรือยังไม่ได้ซ่อมแซมทรัพย์ที่เช่าให้อยู่ในสภาพสะอาดเรียบร้อย ผู้เช่ายอมให้ผู้ให้เช่ามีสิทธิตัดกุญแจเก่า เปลี่ยนตัวล็อคกุญแจใหม่ และเข้าครอบครองทรัพย์ที่เช่าได้ โดยไม่ถือว่าเป็นการบุกรุก หรือทำให้เสียทรัพย์ หรือเป็นกระทำความผิดตามกฎหมายใดๆ ทั้งสิ้น และให้ผู้ให้เช่ามีสิทธิย้ายบุคคล หรือทรัพย์สินของผู้เช่าออกจากสถานที่เช่า หรือจัดการซ่อมแซมทรัพย์ที่เช่าให้อยู่ในสภาพสะอาดเรียบร้อย โดยผู้เช่าจะต้องรับผิดในค่าใช้จ่ายต่างๆ ที่ผู้ให้เช่าเสียไป และผู้ให้เช่าจะไม่รับผิดชอบใดๆ หากเกิดการสูญหาย หรือเสียหายแก่ทรัพย์สินของผู้เช่าในระหว่างขนย้าย
