If Monsanto determines reasonably and in good faith that there has been a breach of any such representation or warranty, it shall have the right unilaterally to terminate this Agreement immediately or to take other appropriate action in accordance with the terms of this Agreement. The Service Provider further agrees to reimburse any consequential damages incurred by Monsanto resulting from the Service Provider's violation of clause 11.1, including but not limited to any, penalty, imposition, duty, tax, levy, fine, action, judgment, order or decree relating to the Service Provider's actual or alleged violation of clause 11.1.
