ข้อ 4. กรณีผิดสัญญา
ในกรณีผู้จะซื้อผิดสัญญาข้อใดข้อหนึ่ง หรือผิดนัดไม่ชำระเงินตามสัญญา หากผู้จะขายได้แจ้งคำเตือนเป็นหนังสือไปยังผู้จะซื้อตามที่อยู่ที่ปรากฎในสัญญานี้ แต่ผู้จะซื้อมิได้ปฏิบัติตามภายในระยะเวลาที่กำหนด ให้สัญญานี้เป็นอันเลิกกันเมื่อเสร็จสิ้นเวลาบอกกล่าวนั้น และเมื่อสัญญาเลิกกันดังกล่าว ผู้จะซื้อยินยอมให้ผู้จะขายริบเงินที่ได้รับไว้แล้วทั้งหมดได้
ในกรณีผู้จะขายผิดสัญญา หรือไม่ไปจดทะเบียนโอนกรรมสิทธิ์ที่ดินให้แก่ผู้จะซื้อ ผู้จะขายยินยอมให้ผู้จะซื้อฟ้องบังคับให้ปฏิบัติตามสัญญากับเรียกค่าเสียหายได้ และให้ถือว่าข้อเท็จจริงทั้งหมดในการขาย ที่ผู้จะขายแจ้งให้แก่ผู้จะซื้อทราบเป็นความจริง
ผู้จะขายขอยืนยันว่าที่ดินดังกล่าวตามสัญญา ผู้จะขายเป็นผู้มีกรรมสิทธิ์ใน หนังสือ น.ส.3 ก. ,หนังสือ ส.ค.1 และ/หรือ เป็นผู้ทำประโยชน์ในที่ดินแปลงดังกล่าวจริง และขอรับรองว่าที่ดินแปลงดังกล่าวสามารถกระทำการโอนเปลี่ยนมือได้ หากที่ดินแปลงดังกล่าวไม่สามารถโอนเปลี่ยนมือได้ ผู้จะขายยินยอมให้ผู้จะซื้อดำเนินคดีทางอาญาในคดีฉ้อโกงหาได้ทันที หากในภายหลังมีการเปลี่ยนชนิด หรือประเภทการถือเอกสารสิทธิทางราชการ เป็นโฉนดที่ดิน ณ สำนักงานที่ดินแล้ว คู่สัญญาทั้งสองฝ่าย ตกลงยอมรับกันว่าที่ดินแปลงดังกล่าว เป็นทรัพย์สินที่จะซื้อขายตามสัญญานี้ด้วย
สัญญานี้ทำขึ้นเป็นสองฉบับ มีข้อความถูกต้องตรงกัน คู่สัญญาทั้งสองฝ่ายได้อ่านและเข้าใจข้อความโดยตลอดแล้ว เห็นว่าถูกต้องตามเจตนา เพื่อเป็นหลักฐานจึงได้ลงลายมือชื่อไว้เป็นสำคัญต่อหน้าพยาน
