“วิษณุ” เผย ไม่วิจารณ์การเมืองไทย เชื่อ เป็นประโยชน์กับ กมธ.ยกร่างรัฐธรรมนูญ
เวลา 13.30 น. วันที่ 22 พ.ค. ที่กระทรวงการต่างประเทศ สถาบันพระปกเกล้าฯจัดบรรยายพิเศษเรื่อง “ถอดบทเรียนการคลี่คลายวิฤตการณ์ทางการเมืองสู่การปฏิรูปในระบอบประชาธิปไตย กรณีศึกษาการร่างรัฐธรรมนูญในต่างประเทศ” ซึ่งได้เชิญผู้เชี่ยวชาญจากฝรั่งเศสและเยอรมัน เป็นผู้บรรยาย
โดยนายวิษณุ เครืองาม รองนายกรัฐมนตรี กล่าวก่อนรับฟังการบรรยายว่า การบรรยายพิเศษครั้งนี้จัดขึ้นเพื่อสร้างความเข้าใจในช่วงของการยกร่างรัฐธรรมนูญ ซึ่งเป็นธรรมดาที่จะต้องมีเสียงวิพากษ์วิจารณ์ ทั้งยังมีเสนอความเห็นอ้างอิงข้อมูลจากประเทศต่างๆ ซึ่งถูกบางผิดบ้าง เพื่อให้เกิดความเข้าใจแก่กลุ่มเป้าหมายอันประกอบด้วย 1.กรรมาธิการ(กมธ.)ยกร่างรัฐธรรมนูญ 2.สภาปฏิรูปแห่งชาติ(สปช.) 3.สภานิติบัญญัติแห่งชาติ(สนช.) 4.ประชาชน 5.สื่อมวลชน ให้กลุ่มเป้าหมายเกิดความรับรู้และเข้าใจในการแก้ไขวิกฤตปัญหา ทั้งนี้ พล.อ.ประยุทธ์ จันทร์โอชา นายกรัฐมนตรีและหัวหน้าคณะรักษาความสงบแห่งชาติ(คสช.) มีแนวคิดให้ในการสร้างความเข้าใจให้กับทุกฝ่าย จึงได้เชิญผู้เชี่ยวชาญจากต่างประเทศ ที่ผ่านพ้นวิกฤต จนเข้าสู่การจัดทำรัฐธรรมนูญ สร้างความปรองดอง จนประเทศฟื้นตัวได้สำเร็จ นำไปสู่การมีรัฐบาลที่มั่นคง มีเสถียรภาพ ประชาชนเดินไปในทิศทางเดียวกัน ดังนั้นจึงได้ผู้เชี่ยวชาญจากประเทศเยอรมันและฝรั่งเศส เพราะเยอรมัน เคยผ่านวิกฤตนาซี วิกฤตสงครามโลก ส่วนฝรั่งเศส ผ่านความขัดแย้งรุนแรงในประเทศจนเข้ามาสู่การยึดอำนาจ จนประเทศฟื้นตัวจนเศรษฐกิจดีขึ้น
นายวิษณุ กล่าวว่า สำหรับศาสตราจารย์ โดมินิค รุสโซ(Dominique Rousseau) จากมหาวิทยาลัยปารีส 1 บรรยายในวันที่ 22 พฤษภาคม เป็นผู้ที่มีชื่อเสียงทางกฏหมายของฝรั่งเศส เป็นผู้เสนอความคิดเรื่องสำคัญและได้รับการยอมรับจากทั่วโลก เป็นผู้เสนอให้ใช้ศาลรัฐธรรมนูญแก้ไขปัญหา และประชาชนต้องสามารถร้องได้โดยตรงได้ ซึ่งเป็นทฤษฏีที่ผ่านการยอมรับมาหลาย 10 ปี จากนั้นวันที่ 26 พฤษภาคม ศาสตราจารย์ มิเชล โชเฟอร์(Michel Troper) จากมหาวิทยาลัยปารีส 10 ซึ่งเป็นเจ้าของทฤษฏีสัจจะนิยม หมายถึงไม่มองอะไรแบบมโน เพ้อเจอ เพ้อฝัน แต่มองแบบตรงตามความจริง เป็นทฤษฏีแบบไม่แสแสร้ง ไม่หวือหวา ซึ่งได้วางหลักสำคัญว่ารัฐธรรมนูญจะศักดิ์สิทธิ์ต่อเมื่อมีการตีความ ศาลที่ตีความจะทำให้รัฐธรรมนูญเป็นจริงเป็นจัง รัฐธรรมนูญที่ดีควรเขียนสั้นๆ ไม่ยาว และปล่อยให้ศาลตีความ ซึ่งศาลต้องผู้น่าเชื่อถือ ประสิทธิภาพ มีมาตรฐานเดียว โดยสหรัฐอเมริกาได้นำทฤษฏีนี้ไปใช้ ทั้งนี้ในวันที่ 26 พฤษภาคมถือเป็นจุดเด่น ไฮไล ของการจัดบรรยายครั้งนี้ และยังเป็นที่สนใจของนักการต่างประเทศ นักการศาล นักปกครองทั่วโลกที่ได้ทราบข่าว อย่างไรก็ตามวันที่ 27 พฤษภาคม ผู้ที่บรรยายคือ ศาสตราจารย์ บลูริส คาร์เบ้น(Ulrich karpen) จากมหาวิทยาลัยฮัมบลูก ประเทศเยอรมัน จะพูดเรื่องการปกครองที่ผ่านมา เล่าประสบการณ์ฮิตเลอร์ นาซี แบ่งประเทศออกเป็นสองส่วน จนวันนี้สามารถปรองดองได้ และเป็นเจ้าหนี้รายใหญ่ของยุโรป เป็นสิ่งที่น่าสนใจ
