   ความสำคัญของกฎบัตรอาเซียนต่อประเทศไทย

          1. ไทยเป็น 1 ใน 5 ของผู้ร่วมก่อตั้งอาเซียน เป็นสถานที่กำเนิดของอาเซียน และมีบทบาทนำในอาเซียนมาโดยตลอด ไทยเป็นประธานอาเซียนในปี 2551-2552 และระหว่างปี 2551-2555  ดร.สุรินทร์ พิศสุวรรณ จะเข้ารับตำแหน่งเลขาธิการอาเซียน ซึ่งเป็นการตอกย้ำบทบาทนำของไทย ทั้งนี้ การมีกฎบัตรอาเซียน  จะช่วยให้อาเซียนมีความเข้มแข็งยิ่งขึ้น จะเป็นการสะท้อนความสำเร็จทั้งของไทยและภูมิภาคนี้โดยรวม

การดำรงตำแหน่งประธานอาเซียนของไทย
          ไทยได้รับหน้าที่ประธานอาเซียน ต่อจากสิงคโปร์ ภายหลังการประชุมรัฐมนตรีต่างประเทศอาเซียน ครั้งที่ 41 ที่สิงคโปร์ในเดือน ก.ค. 2551 การดำรงตำแหน่งประธานอาเซียนของไทยอยู่ในช่วงเวลาที่สำคัญเนื่องจาก (1) กฎบัตรอาเซียนจะมีผลใช้บังคับ (2) การจัดทำแผนงานสำหรับการจัดตั้งประชาคมการเมืองความมั่นคง ประชาคมเศรษฐกิจ และประชาคมสังคมและวัฒนธรรมเพื่อมุ่งไปสู่การรวมตัวเป็นประชาคมอาเซียนในปี 2558 และ (3) อยู่ในช่วงเวลาเดียวกับที่คนไทย คือ ดร. สุรินทร์ พิศสุวรรณ    ดำรง ตำแหน่งเลขาธิการ
อาเซียน (วาระ 5 ปี ตั้งแต่ 1 ม.ค. 2551-31 ธ.ค. 2555)โดยที่กฎบัตรอาเซียนกำหนดให้ วาระการดำรงตำแหน่งประธานอาเซียนเป็นไปตามปีปฏิทิน ดังนั้น ไทยจะดำรงตำแหน่งประธานอาเซียนเป็นเวลา 1 ปี 6 เดือนคือ ตั้งแต่ ก.ค. 2551 - ธ.ค. 2552

ยุทธศาสตร์การดำรงตำแหน่งประธานอาเซียนของไทย
           กระทรวงการต่างประเทศได้หารือ กับหน่วยราชการที่เกี่ยวข้องและได้ร่วมกันกำหนดยุทธศาสตร์ที่สำคัญในวาระที่ ไทยจะดำรงตำแหน่งประธานอาเซียน ดังนี้
           1.  สร้างความตระหนักรู้เกี่ยวกับอาเซียนให้ประชาชนได้รับทราบ
           2.  ส่งเสริมความรู้และความเข้าใจเกี่ยวกับบทบาทไทยในฐานะประธานอาเซียน
           3.  เสริมสร้างประชาคมการเมืองและความมั่นคงภายในปี 2558
           4.  เสริมสร้างประชาคมเศรษฐกิจอาเซียนภายในปี 2558
           5.  เสริมสร้างประชาคมสังคมและวัฒนธรรมภายในปี 2558
           6.  ส่งเสริมความร่วมมือกับประเทศคู่เจรจาของอาเซียน
ทั้งนี้ กระทรวงการต่างประเทศได้กำหนดเป้าหมายสำคัญที่ไทยจะผลักดันในช่วงที่ดำรงตำแหน่งประธานอาเซียนไว้ 3 ประการ ได้แก่
         1. การอนุวัติข้อผูกพันภายใต้กฎบัตรอาเซียน (Realising the commitments under the ASEAN Charter) โดยเฉพาะการยกร่างขอบเขตอำนาจหน้าที่ขององค์กรต่าง ๆ ที่จะจัดตั้งขึ้น ได้แก่ กลไกสิทธิมนุษยชนอาเซียน และคณะกรรมการผู้แทนถาวรประจำอาเซียน 
ณ กรุงจาการ์ตา เป็นต้น
         2. การทำให้อาเซียนเป็นประชาคมที่มีประชาชน เป็นจุดศูนย์กลาง (Revitalising ASEAN as a people-centred Community) ซึ่งหมายถึงการเสริมสร้างความตระหนักรู้เกี่ยวกับอาเซียนในหมู่ประชาชนการ ส่งเสริมการมีส่วนร่วมของประชาชนและภาคประชาสังคมในการสร้างประชาคมอาเซียน
          3. การเสริมสร้างการพัฒนาและความมั่นคงของ มนุษย์สำหรับประชาชนทุกคนในภูมิภาค (Reinforcing human development and security for all the peoples of the region)   โดยส่งเสริมให้ความร่วมมือของอาเซียนตอบสนองต่อผลประโยชน์ของประชาชนให้มาก 
ที่สุด โดยเฉพาะการแก้ไขปัญหาที่มีผลกระทบต่อความเป็นอยู่ของประชาชน เช่น ความมั่นคงด้านอาหาร พลังงาน การจัดการภัยพิบัติและการเสริมสร้างเสถียรภาพด้านการเงินในภูมิภาค
  

กฎบัตรอาเซียนคืออะไร
           กฎบัตรอาเซียนคือ   ธรรมนูญของอาเซียนที่จะทำให้อาเซียนมีสถานะเป็นนิติบุคคล  เป็นการวางกรอบกฎหมายตลอดจนโครงสร้างองค์กรให้กับอาเซียน  โดยนอกจากการประมวลสิ่งที่ถือเป็นค่านิยม หลักการ และแนวปฏิบัติในอดีตของอาเซียนมาประกอบกันเป็นข้อปฏิบัติอย่างเป็นทางการสำหรับประเทศสมาชิกแล้ว  ยังมีการปรับปรุงแก้ไขและสร้างกลไกใหม่ขึ้นพร้อมกับกำหนดขอบเขตหน้าที่และความรับผิดชอบขององค์กรสำคัญในอาเซียน  ตลอดจนความสัมพันธ์ในการดำเนินงานขององค์กรเหล่านี้  เพื่อให้สอดคล้องกับความเปลี่ยนแปลงในโลกปัจจุบัน  โดยมีเป้าหมายให้อาเซียนเป็นองค์กรที่มีประสิทธิภาพมากขึ้น
          กฎบัตรอาเซียนประกอบด้วย บทบัญญัติ 13 บท 55 ข้อ ครอบคลุมเป้าหมายและหลักการ สมาชิกภาพ โครงสร้างองค์กรของอาเซียน องค์กรที่มีความสัมพันธ์กับอาเซียน เอกสิทธิ์และความคุ้มกัน กระบวนการตัดสินใจ การระงับข้อพิพาท 
งบประมาณและการเงิน การบริหารจัดการ เอกลักษณ์และสัญลักษณ์ของอาเซียน และความสัมพันธ์กับภายนอก

วัตถุประสงค์ของกฎบัตรอาเซียน
       1.  เพื่อธำรงรักษาและเพิ่มพูนสันติภาพ ความมั่นคง และเสถียรภาพ กับทั้งเสริมสร้างคุณค่าทางสันติภาพในภูมิภาคให้มากขึ้น
       2.  เพื่อเพิ่มความสามารถในการปรับตัวสู่สภาวะปกติของภูมิภาคโดยการส่งเสริมความร่วมมือด้านการเมือง ความมั่นคง เศรษฐกิจและสังคมวัฒนธรรมให้แน่นแฟ้นยิ่งขึ้น
      3.   เพื่อธำรงรักษาเอเชียตะวันออกเฉียงใต้ให้เป็นเขตปลอดอาวุธนิวเคลียร์และปราศจากอาวุธที่มีอานุภาพทำลายล้างสูงอื่นๆ ทุกชนิด
      4.  เพื่อให้มั่นใจว่าประชาชนและรัฐสมาชิกของอาเซียนอยู่ร่วมกับประชาคมโลกได้โดยสันติในสภาวะที่เป็นธรรม มีประชาธิปไตยและมีความสมานสามัคคี
