ในกรณีผู้เช่าผิดสัญญาไม่ว่าข้อใดข้อหนึ่ง หรือหลายข้อรวมกัน ผู้ให้เช่ามีสิทธิที่จะบอกกล่าวให้ผู้เช่าปฏิบัติตามสัญญาภายในกำหนดเวลาที่ผู้ให้เช่าเห็นสมควร หรือเรียกค่าเสียหาย หรือบอกเลิกสัญญา โดยบอกกล่าวล่วงหน้าไม่น้อยกว่า ๒ เดือน ( สองเดือน ) เพื่อให้ผู้เช่าทราบ และให้ถือว่าสัญญาเลิกกันในทันที หรือฟ้องร้องขอให้ศาลมีคำสั่งให้ผู้เช่าปฏิบัติตามสัญญาต่อไป หรือผู้ให้เช่าจะเลือกใช้สิทธิอย่างใดอย่างหนึ่ง หรือเลือกใช้สิทธิดังกล่าวรวมกันก็ได้
