2.9.3. วิธีประกวดราคา
1. ให้เจ้าหน้าที่พัสดุจัดทำเอกสารประกวดราคา ตามตัวอย่างที่ กวพ. กำหนดหรือตามแบบที่ผ่านการตรวจพิจารณาของสำนักอัยการสูงสุดแล้ว
การจัดทำเอกสารประกวดราคารายใดจำเป็นต้องมีข้อความหรือรายการแตกต่างไปจากที่ กวพ. กำหนดหรือแบบที่ผ่านการตรวจพิจารณาของสำนักอัยการสูงสุดแล้ว โดยมีสาระสำคัญตามที่กำหนดไว้ในตัวอย่างหรือแบบดังกล่าว และไม่ทำให้ทางราชการเสียเปรียบก็ให้กระทำได้ เว้นแต่หัวหน้าส่วนราชการเห็นว่าจะมีปัญหาในทางเสียเปรียบหรือไม่รัดกุมพอ ก็ส่งร่างเอกสารประกวดราคาไปให้สำนักอัยการสูงสุดตรวจพิจารณาก่อน
การเผยแพร่เอกสารประกวดราคาให้จัดทำเป็นประกาศ และมีสาระสำคัญดังนี้
1. รายการพัสดุที่ต้องการซื้อ หรืองานที่ต้องการจ้าง
2. คุณสมบัติของผู้มีสิทธิ์เข้าประกวดราคา
3. กำหนดวัน เวลา รับซอง ปิดการรับซอง และเปิดซองประกวดราคา
4. สถานที่และระยะเวลาในการขอรับ หรือขอซื้อเอกสารการประกวดราคาและราคาของเอกสาร
5. แหล่งเงินกู้และประเทศผู้มีสิทธ์เข้าประกวดราคาในกรณีประกวดราคานานาชาติ
การซื้อหรือการจ้างโดยวิธีประกวดราคา ให้หัวหน้าเจ้าหน้าที่พัสดุมีหน้าที่รับผิดชอบควบคุมดูแลและจัดทำหลักฐานการเผยแพร่และการปิดประกาศประกวดราคาภายในระยะเวลาที่กำหนด โดยให้เจ้าหน้าที่พัสดุดำเนินการดังนี้
(1) ปิดประกาศประกวดราคาโดยเปิดเผย ณ ที่ทำการของส่วนราชการนั้น การปิดประกาศดังกล่าวให้กระทำในตู้ปิดประกาศที่มีกุญแจปิดตลอดเวลา โดยผู้ปิดประกาศและผู้ปลดประกาศออกจากตู้ปิดประกาศจะต้องจัดทำหลักฐานการปิดประกาศและการปลดประกาศออก เป็นหนังสือมีพยานบุคคลรับรอง ทั้งนี้ ผู้ปิดประกาศและการปลดประกาศออก จะต้องมิใช่บุคคลเดียวกัน และจะต้องมิใช่บุคคลที่เป็นพยานในแต่กรณีด้วย
(2) ส่งไปประกาศทางวิทยุกระจายเสียง และ/หรือประกาศในหนังสือพิมพ์
(3) ส่งให้กรมประชาสัมพันธ์ และองค์กรสื่อสารมวลชนแห่งประเทศไทย เพื่อเผยแพร่
(4) ส่งไปเผยแพร่ที่ศูนย์รวมข่าวประกวดราคาของทางราชการ โดยให้ส่งเอกสารประกวดราคาไปพร้อมกันด้วย
(5) ส่งให้สำนักงานตรวจเงินแผ่นดินหรือสำนักงานตรวจเงินแผ่นดินภูมิภาค แล้วแต่กรณีโดยให้ส่งเอกสารประกวดราคาไปพร้อมกันด้วย
นอกจากการดำเนินงานตามวรรคหนึ่ง หากเห็นสมควรจะส่งประกาศไปยังผู้มีอาชีพขายหรือรับจ้างทำงานนั้นโดยตรง หรือจะโฆษณาด้วยวิธีอื่นอีกด้วยก็ได้
การส่งประกาศประกวดราคาตามวรรคหนึ่ง หากจัดส่งทางไปรษณีย์ให้จัดส่งโดยใช้บริการด่วนพิเศษ (EMS) เว้นแต่ท้องที่ใดไม่มีบริการไปรษณีย์ด่วนพิเศษ (EMS) จึงให้จัดส่งทางไปรษณีย์ลงทะเบียน
การดำเนินการตามวรรคหนึ่ง วรรคสอง และวรรคสาม ให้กระทำก่อนการให้หรือการขายเอกสารประกวดราคาไม่น้อยกว่า 7 วันทำการ
สำหรับการซื้อหรือการจ้างโดยวิธีประกวดราคานานาชาติ ให้ส่วนราชการถือปฏิบัติตามหลักเกณฑ์ของแหล่งเงินกู้หรือแล่งให้เงินช่วยเหลือ
การให้หรือการขายเอกสารประกวดราคา รวมทั้งเอกสารที่เกี่ยวกับคุณลักษณะเฉพาะหรือรายละเอียด ให้กระทำ ณ สถานที่ที่สามารถติดต่อได้โดยสะดวกและไม่เป็นเขตหวงห้ามและจะต้องจัดเตรียมเอกสารประกวดราคาไว้ให้มากพอสำหรับความต้องการผู้มาขอรับหรือขอซื้อที่มีอาชีพขายหรือรับจ้างทำงานนั้นรายละ 1 ชุด โดยไม่มีเงื่อนไขอื่นใดในการให้หรือการขาย
การให้หรือการขายเอกสารประกวดราคา ต้องกระทำไม่น้อยกว่า 7 วันทำการ และจะต้องมีช่วงเวลาสำหรับการคำนวณราคาของผู้ประสงค์จะเข้าเสนอราคาหลังปิดการให้หรือการขายเอกสารประกวดราคาจนถึงก่อนวันรับซองประกวดราคาไม่น้อยกว่า 7 วันทำการ หรือไม่น้อยกว่าจำนวนวันที่มากว่านั้นตามที่ กวพ. กำหนดโดยคำนึงถึงขนาด ปริมาณ และลักษณะของพัสดุที่จะซื้อหรือจ้าง
ในกรณีที่มีการขาย ให้กำหนดราคาพอสมควรกับค่าใช้จ่ายที่ทางราชการต้องเสียไปในการจัดทำสำเนาเอกสารประกวดราคานั้น
ถ้ามีการยกเลิกการประกวดราคาครั้งนั้นและมีการประกวดราคาใหม่ให้ผู้รับหรือซื้อเอกสารประกวดราคาในการประกวดราคาครั้งก่อน มีสิทธิใช้เอกสารประกวดราคานั้นหรือได้รับเอกสารประกวดราคาใหม่โดยไม่ต้องเสียค่าซื้อเอกสารประกวดราคาอีก
4. ในกรณีที่การซื้อหรือการจ้างใดมีรายละเอียดที่มีความซับซ้อน หรือมีความจำเป็นโดยสภาพของการซื้อหรือการจ้างที่ต้องมีการชี้แจงรายละเอียดหรือการชี้สถานที่ ให้ส่วนราชการกำหนดวัน เวลา และสถานที่ในการชี้แจงรายละเอียดหรือการชี้สถานที่ในประกาซประกวดราคา
ก่อนวันปิดการรับซองประกวดราคา หากส่วนราชการเห็นว่ามีความจำเป็นที่จะต้องกำหนดรายละเอียดเพิ่มเติมหรือมีการชี้สถานที่อันเป็นการแก้ไขคุณลักษณะเฉพาะที่เป็นสาระสำคัญซึ่งมิได้กำหนดไว้ในเอกาสารประกวดราคาตั้งแต่ต้น ให้ส่วนราชการจัดทำเป็นเอกสารประกวดราคาเพิ่มเติมและให้ระบุ วัน เวลา และสถานที่ในการชี้แจงราละเอียดหรือการชี้สถานที่ไว้ด้วย และให้ดำเนินการ โดยอนุโลมรวมทั้งให้แจ้งเป็นหนังสือให้ผู้ที่ได้รับหรือได้ซื้อเอกสารประกวดราคาไปแล้วทุกรายทราบโดยมิชักช้า
การชี้แจงรายละเอียดหรือการชี้สถานที่ตามวรรคหนึ่งหรือวรรคสองให้เจ้าหน้าที่ผู้รับผิดชอบจัดทำบันทึกการชี้แจงรายละเอียดหรือการชี้สถานที่เป็นลายลักษณ์อักษรไว้เป็นหลักฐานทุกครั้ง
ถ้ามีการดำเนินการตามวรรคสอง ให้ส่วนราชการพิจารณาเลื่อน วัน เวลา รับซอง การปิดการรับซอง และการเปิดซองประกวดราคาตามความจำเป็นแก่กรณีด้วย
5. นอกจากกรณีที่กำหนดไว้ เมื่อถึงกำหนดวันรับซองประกวดราคา ห้ามมิให้หล่นหรือเลื่อน หรือเปลี่ยนแปลงกำหนดเวลารับซอง และเปิดซองประกวดราคา
การรับซองทางไปรษณีย์จะกระทำมิได้ เว้นแต่การประกวดราคานานาชาติที่กำหนดให้มีการยื่นซองทางไปรษณีย์ได้ โดยให้ถือปฏิบัติตามโดยอนุโลม
