บรรดาทรัพย์สินทางปัญญา ไม่ว่าจะเป็นลิขสิทธิ์ สิทธิบัตร การออกแบบ สิทธิในชื่อทางการค้า สัญลักษณ์ รูปทรง เครื่องหมายการค้า เครื่องหมายบริการ และสิทธิในทรัพย์สินทางปัญญาอื่นใด ซึ่งคู่สัญญาฝ่ายใดฝ่ายหนึ่งเป็นเจ้าของ หรือเป็นผู้สร้างสรรค์ ให้ถือว่ายังคงเป็นของคู่สัญญาฝ่ายโดยห้ามมิให้อีกฝ่ายนำข้อมูลดังกล่าวไปใช้เพื่อประโยชน์หรือดำเนินการอื่นใดนอกเหนือจากการปฏิบัติหน้าที่ภายใต้สัญญาฉบับนี้ เว้นแต่เป็นการอนุญาตให้ใช้ตามสัญญาฉบับนี้ คู่สัญญาอีกฝ่ายหนึ่งไม่อาจนำทรัพย์สินทางปัญญาของคู่สัญญาอีกฝ่ายหนึ่งไปเผยแพร่ ทำซ้ำ หรือดัดแปลง หรือใช้ หรืออนุญาตให้บุคคลอื่นนำไปใช้ได้ ทั้งนี้ในส่วนของงานที่สร้างสรรค์ขึ้นใหม่ หรือได้พัฒนาขึ้นจากทรัพย์สินทางปัญญาเดิมที่มีอยู่แล้วตามสัญญาฉบับนี้ให้ตกเป็นกรรมสิทธิ์ของคู่สัญญาฝ่ายที่ดำเนินการสร้างสรรค์หรือพัฒนาดังกล่าว
ข้อ 15. เหตุสุดวิสัย
