หมายความว่า การที่บุคคลกระทำการอย่างใดอย่างหนึ่ง ซึ่งในขณะนั้นไม่เป็นความผิดหรือไม่มีกฏหมายบัญญัติไว้เป็นความผิด แต่ต่อมาภายหลังมีกฎหมายบัญญัติให้เป็นความผิดเพื่อลงโทษการทำกระทำนั้นๆ จะทำให้บุคคลทั้งหลายไม่กล้ากระทำการใดๆ เพราะเกรงว่าจะมีกฎหมายออกมาภายหลัง และเกรงว่าจะเป็นความผิด
