11.9. การบอกเลิกสัญญา

11.9.1. ถ้าผู้รับจ้างปฏิบัติงานผิดข้อกำหนดในสัญญาจ้างข้อใดข้อหนึ่ง เช่น ก่อสร้างไม่ตรงตามแบบแปลนใช้วัสดุ / อุปกรณ์ไม่ตรงตามข้อกาหนดหรือฝ่าฝืนข้อกำหนดด้านความปลอดภัยของ ปตท.กช.
ผู้ว่าจ้างมีสิทธิ์บอกเลิกสัญญาได้ทันที

11.9.2. ถ้ามีเหตุให้ผู้ว่าจ้างเห็นได้ว่าผู้รับจ้างไม่มีความสามารถที่จะดำเนินงานให้เป็นไปตามแบบแปลนและข้อกาหนดในสัญญาจ้าง หรือผู้รับจ้างไม่มีความสามารถที่จะดำเนินงานให้แล้วเสร็จภายในกำหนดระยะเวลาตามสัญญาจ้างได้ ผู้ว่าจ้างมีสิทธิ์บอกเลิกสัญญาได้ทันที โดยผู้รับจ้างยินยอมชดใช้ค่าเสียหายและค่าใช้จ่ายใดๆที่เกิดขึ้นจากการบอกเลิกสัญญาจ้าง
