ถึงวันนี้ เริ่มมีแนวโน้มแล้วว่า อาจจะมีประชามติว่าด้วยร่างรัฐธรรมนูญ 2558 เมื่อทั้งคณะกรรมาธิการยกร่างรัฐธรรมนูญ สภาปฏิรูปแห่งชาติ และสภานิติบัญญัติแห่งชาติ ต่างมีความเห็นไปในทางเดียวกันว่า เห็นควรให้มีประชามติ ส่วนคำถามที่ว่า ถ้าผลของประชามติเป็น “ไม่รับร่างรัฐธรรมนูญ” แล้วจะต้องดำเนินการต่อไปอย่างไรนั้น ดูเหมือนจะมี “ทางเลือก” อยู่เพียงสองทางคือ ให้นำเอารัฐธรรมนูญฉบับใดฉบับหนึ่งในอดีตมาปรับใช้ หรือให้คณะกรรมาธิการทำการยกร่างใหม่ทั้งฉบับอีกรอบหนึ่ง

แต่ยังมีข้อเสนอจากนักการเมืองและประชาชนแยกเป็นสามแนวทางคือ ให้นำรัฐธรรมนูญ 2550 (ข้อเสนอของพรรคประชาธิปัตย์) หรือรัฐธรรมนูญ 2540 (นักการเมืองบางคนในพรรคเพื่อไทย) มาปรับใช้ หรือให้มีสภาร่างรัฐธรรมนูญที่มาจากการเลือกตั้งเพื่อยกร่างใหม่ทั้งฉบับ (ข้อเสนอของกลุ่มเรียกร้องประชามติที่เป็นประชาธิปไตย)

อย่างไรก็ตาม ยังมีคนจำนวนหนึ่งที่ยืนยันให้คว่ำบาตรกระบวนการทั้งหมดของรัฐธรรมนูญชั่วคราว 2557 ซึ่งก็คือ คว่ำบาตรประชามติ คว่ำบาตรรัฐธรรมนูญ และคว่ำบาตรการเลือกตั้ง รวมทั้ง เรียกร้องกดดันให้พรรคการเมืองใหญ่ทั้งสองพรรคร่วมกันคว่ำบาตรกระบวนการข้างต้นทั้งหมดด้วย

เหตุผลของแนวทาง “คว่ำบาตรทุกอย่าง” คือ เป็นการปฏิเสธรัฐประหาร 22 พฤษภาคม 2557 และผลพวงทั้งหมด ซึ่งก็คือ รัฐธรรมนูญชั่วคราว 2557 และกระบวนการยกร่างรัฐธรรมนูญใหม่ทั้งกระบวน
แน่นอนว่า ผู้ที่รักประชาธิปไตยจะต้องคัดค้านรัฐประหาร รัฐธรรมนูญชั่วคราวและการร่างรัฐธรรมนูญใหม่ที่กำลังกระทำกันอยู่ แต่การ “คว่ำบาตรทุกอย่าง” นั้นก็ไม่ใช่วิธีการที่จะไปบรรลุผลที่เป็นจริงในทางปฏิบัติ

ข้ออ้างที่ว่า “ปฏิเสธรัฐประหารและรัฐธรรมนูญชั่วคราว” ก็เป็นเพียงโวหารที่ว่างเปล่า เพราะความเป็นจริงในชีวิตนั้นเป็นตรงข้ามคือ ทุกคนล้วนได้รับผลกระทบและต้องปรับเปลี่ยนพฤติกรรม บางคนต้องหลบหนีไปต่างประเทศ หลายคนถูกเรียกตัว ควบคุมตัว มีคดีในศาล ส่วนใหญ่ต้องปรับเปลี่ยนกิจกรรมที่เคยทำและอยู่อย่างหวาดระแวง นี่คือผลที่เป็นจริงของรัฐประหารและมาตรา 44 ของรัฐธรรมนูญชั่วคราว โดยที่ผู้ได้รับผลกระทบก็ต้องจำยอมโดยดุษฎี แม้ปากจะยืนยันว่า “ไม่ยอมรับรัฐประหารและรัฐธรรมนูญชั่วคราว” ก็ตาม!

การเสนอแนวทางแบบสุดโต่งที่ “ปฏิเสธทุกอย่าง คว่ำบาตรทุกอย่าง” นั้น ฟังดูดี “มีหลักการ” และ “ถูกใจ” ผู้คนจำนวนหนึ่งก็เพราะเป็นข้อเสนอที่สอดคล้องกับอารมณ์โกรธและผิดหวังที่แพร่หลายอยู่ในหมู่ผู้รักประชาธิปไตยปัจจุบัน

การ “คว่ำบาตรทุกอย่าง” แม้จะฟังดูดีในทางการเมือง แต่ผลทางปฏิบัติก็คือ การปล่อยให้กระบวนการของรัฐธรรมนูญชั่วคราวดำเนินไปอย่างลื่นไหลจนถึงประกาศใช้รัฐธรรมนูญ มีการเลือกตั้งและจัดตั้งรัฐบาลใหม่โดยไร้อุปสรรคใด ๆ นั่นเอง เพราะภายใต้อำนาจเบ็ดเสร็จของมาตรา 44 การคว่ำบาตรทุกอย่างดังว่าก็คือการที่คนจำนวนหนึ่งบอกกับตัวเองว่า “ไม่ยอมรับรัฐประหาร” แล้วก็ไม่ทำอะไร เป็นการมัดมือมัดเท้าและปิดประตูตัวเองออกไปจากการต่อสู้ทางการเมืองในขณะนั้น ขณะที่ประชาชนส่วนข้างมากไม่ได้รับรู้อะไรนอกจากเฝ้าดูกระบวนการร่างรัฐธรรมนูญที่ดำเนินไปเรื่อย ๆ จนมีการเลือกตั้ง

แม้แต่การที่คนกลุ่มนี้ “คว่ำบาตรประชามติ” ด้วยการออกไป “ทำบัตรเสีย” หรือไม่ออกไปใช้สิทธิ์ลงเสียง ก็จะไม่มีผลทางการเมืองใด ๆ เพราะการกระทำดังกล่าวจะถูกนับเป็นจำนวน “บัตรเสีย” และจำนวนคน “นอนหลับทับสิทธิ์” ที่เพิ่มขึ้นเท่านั้น ดังเช่นบทเรียนจากการเคลื่อนไหว “โหวตโน” ของกลุ่มพันธมิตรประชาชนเพื่อประชาธิปไตยในการเลือกตั้งปี 2554 ที่กลายเป็นการละทิ้งเวทีการต่อสู้และทำลายความน่าเชื่อถือของตัวเองไปในที่สุด

ความจริงแล้ว ผู้ที่เสนอให้ “คว่ำบาตรทุกอย่าง” ก็รู้ถึงข้อจำกัดของประชาชนที่ไม่สามารถเคลื่อนไหวด้วยตัวเองได้ในสถานการณ์ปัจจุบัน จึงมีข้อเสนอเพื่อแก้เกี้ยวคือ ให้ประชาชน “กดดันพรรคการเมืองมาเป็นด่านหน้าคว่ำบาตรรัฐธรรมนูญ ประชามติ และการเลือกตั้ง” โดยให้เหตุผลว่า ประชาชนไม่ต้องเสี่ยงออกไป “เผชิญหน้า” กับคณะรัฐประหารด้วยตัวเอง แต่ “ดันหลังพรรคการเมืองให้ไปชนกับคณะรัฐประหาร” แทน!

แต่นี่เป็นข้อเสนอที่ไร้เดียงสาทางการเมืองยิ่ง เพราะนักการเมืองย่อมมีผลประโยชน์ของตนเองเป็นสำคัญ ซึ่งก็คือ มีการเลือกตั้ง ได้เข้าสู่สภาผู้แทนราษฎรและจัดตั้งรัฐบาล ประสบการณ์ในช่วงสิบปีมานี้ ยังไม่เพียงพออีกหรือที่จะเรียนรู้ว่า พรรคการเมืองในระบบเลือกตั้งไม่อาจเป็นกองหน้าต่อสู้เพื่อประชาธิปไตยได้ สิ่งที่พวกเขาทำได้อย่างมากที่สุดคือ การสนับสนุนประชาชนอยู่ข้างหลัง และคอยรับดอกผลจากการต่อสู้ของประชาชนเท่านั้น!

เมื่อพิเคราะห์ให้ถึงที่สุด แนวทาง “คว่ำบาตรทุกอย่าง” ก็คือ การเอา “หลักการสวยหรู” ที่สุดโต่งชุดหนึ่งมาปกปิดอารมณ์พ่ายแพ้และผิดหวังของตนเอง มาเป็นข้ออ้างรองรับการที่จะไม่ทำอะไรทั้งสิ้น ในทางปฏิบัตินี่คือ “การยอมแพ้” ทางการเมืองที่ตกแต่งด้วยโวหารหลักการสวยหรู และด้วยข้ออ้าง “ให้พรรคการเมืองออกหน้า” แทน

การดำเนินงานทางการเมืองจะต้องยึดหลักการและแนวทางใหญ่ไว้ให้มั่น แต่การกระทำทางยุทธวิธีก็ต้องมีความยืดหยุ่น ปรับเปลี่ยนไปตามสถานการณ์ที่เป็นจริงโดยพิจารณาจากผลสะเทือนทางการเมืองในสาธารณะเป็นสำคัญ สถานการณ์ปัจจุบันนั้นยากลำบาก ช่องทางการเมืองก็ตีบตันและอันตราย เราจึงต้องใช้ประโยชน์จากช่องทางทุกด้านเท่าที่จะหาได้ เพื่อส่งผลสะเทือนทางการเมืองไปสู่สาธารณะ ซึ่งในภาวการณ์ปัจจุบันก็คือ การผลักดันให้มีประชามติและให้มีการอภิปรายสาธารณะในประเด็นรัฐธรรมนูญได้ (แม้ว่า อำนาจตาม ม.44 จะยังคงอยู่ก็ตาม)

แน่นอนว่า มีความเป็นไปได้สูงมากที่ผลประชามติจะเป็น “รับร่างรัฐธรรมนูญ” จึงได้มีข้อโต้แย้งอีกข้อหนึ่งคือ นี่มิเท่ากับไปสร้างความชอบธรรมให้กับรัฐธรรมนูญ 2558 เช่นเดียวกับรัฐธรรมนูญ 2550 ดอกหรือ? คำตอบคือ ประชามติที่ “รับร่างรัฐธรรมนูญ” จะไม่มีผลเปลี่ยนแปลงสถานการณ์ระยะยาวอย่างมีนัยสำคัญ เช่นเดียวกับที่ประชามติปี 2550 ก็ไม่ได้เปลี่ยนแปลงสถานการณ์ส่วนทั้งหมดในขณะนั้น
