หลักความเสมอภาคถือว่าเป็นหลักพื้นฐานของศักดิ์ศรีของความเป็นมนุษย์ ซึ่งมนุษย์ย่อมได้รับการรับรองและคุ้มครองจากกฎหมายอย่างเท่าเทียมกันในฐานะที่เป็นมนุษย์โดยมิต้องคำนึงถึงคุณสมบัติอื่นๆ อาทิเชื้อชาติ ศาสนา ภาษา ถิ่นกำเนิด เป็นต้น และขณะเดียวกันก็ถือได้ว่าหลักความเสมอภาคนี้เป็นหลักที่ควบคุมมิให้รัฐใช้อำนาจของตนตามอำเภอใจ และหลักความเสมอภาคจึงเป็นหลักสำคัญในการรับรองและคุ้มครองสิทธิเสรีภาพของประชาชน

บุคคลย่อมมีความเสมอภาคที่จะได้รับการรับรองและคุ้มครองตามกฎหมายอย่างเท่าเทียมกัน (Fairness) ซึ่งหมายถึง “หลักความเสมอภาคเบื้องหน้ากฎหมาย” (Equality before the law) ที่เป็นการยอมรับสิทธิเสรีภาพอันเป็นสาระสำคัญของความเป็นมนุษย์ที่ติดตัวมนุษย์มาตั้งแต่กำเนิดและไม่อาจพรากไปได้ จึงเป็นการแสดงให้เห็นถึงการยอมรับตามทฤษฎีกฎหมายธรรมชาติ (Natural law)

หลักความเสมอภาคนั้นมีความสัมพันธ์อย่างใกล้ชิดกับหลักเสรีภาพเนื่องจากเป็นหลักการที่จะทำให้การใช้เสรีภาพเป็นไปอย่างเสมอกันทุกผู้ทุกคน แต่หากเสรีภาพสามารถใช้ได้เพียงบุคคลบางคนเท่านั้นในขณะที่คนบางกลุ่มบางคนเข้าถึงไม่ได้ในกรณีดังกล่าวก็ไม่ถือว่ามีเสรีภาพแต่ประการใด9 ความเสมอภาคจึงเป็นฐานของเสรีภาพและเป็นหลักประกันในการทำให้เสรีภาพเกิดขึ้นได้จริง ดังนั้นหลักความเสมอภาคใต้กฎหมายจึงเป็นหลักการที่ทำให้มีการปฏิบัติต่อบุคคลที่เกี่ยวข้องกับเรื่องนั้นๆ อย่างเท่าเทียมกันหรือไม่เลือกปฏิบัติ (non-discrimination) ทั้งนี้การปฏิบัติตามหลักความเสมอภาคนั้นจะต้องปฏิบัติต่อสิ่งที่มีสาระสำคัญเหมือนกันอย่างเท่าเทียมกัน และจะต้องปฏิบัติต่อสิ่งที่มีสาระสำคัญแตกต่างกันให้แตกต่างกันไปตามลักษณะของเรื่องนั้นๆ จึงจะทำให้เกิดความยุติธรรมภายใต้หลักความเสมอภาคขึ้นได้




1.3 ประเภทของหลักความเสมอภาค



หลักความเสมอภาคเมื่อพิจารณาจากบทบัญญัติแห่งกฎหมายสามารถแยกประเภทของหลักความเสมอภาคได้ 2 ประเภทดังนี้10



1.3.1 หลักความเสมอภาคทั่วไป


หลักความเสมอภาคทั่วไปเป็นสิทธิขั้นพื้นฐานของบุคคลทุกคนที่อาจกล่าวอ้างกับการกระทำใดๆของรัฐได้ หากเรื่องนั้นมิได้มีการกำหนดไว้ในหลักความเสมอภาคเฉพาะเรื่อง แต่หากเรื่องใดมีหลักความเสมอภาคเฉพาะเรื่องกำหนดไว้แล้วก็ให้พิจารณาไปตามหลักความเสมอภาคเฉพาะเรื่องนั้นๆ



1.3.2 หลักความเสมอภาคเฉพาะเรื่อง


หลักความเสมอภาคเฉพาะเรื่องคือ หลักความเสมอภาคที่ใช้เฉพาะภายในขอบเขตเรื่องใดเรื่องหนึ่งเป็นการเฉพาะ เช่น หลักความเสมอภาคเฉพาะเรื่องเกี่ยวกับชายและหญิง เป็นต้น



ความสัมพันธ์ระหว่างหลักความเสมอภาคทั่วไปกับหลักความเสมอภาคเฉพาะเรื่องนั้น ถือได้ว่าหลักความเสมอภาคทั่วไปเป็นพื้นฐานของหลักความเสมอภาคเฉพาะเรื่อง แต่หลักความเสมอภาคทั่วไปนั้นสามารถนำไปใช้ได้กับทุกๆเรื่องโดยไม่จำกัดขอบเขตเรื่องใดเรื่องหนึ่งและบุคคลทุกๆคนย่อมอ้างหลักความเสมอภาคทั่วไปได้ ส่วนหลักความเสมอภาคเฉพาะเรื่องอาจถูกจำกัดโดยใช้เฉพาะเรื่องหรือเฉพาะกลุ่มบุคคลที่รัฐธรรมนูญมุ่งคุ้มครองเท่านั้น โดยหลักความเสมอภาคเฉพาะเรื่องนั้นยังถือเป็นหลักกฎหมายพิเศษซึ่งย่อมมาก่อนหลักความเสมอภาคทั่วไป ถ้ากฎเกณฑ์ใดได้รับการพิจารณาหลักความเสมอภาคเฉพาะเรื่องแล้วก็ไม่จำต้องนำมาพิจารณาตามหลักความเสมอภาคทั่วไปอีก
