จากการศึกษา คู่มือการจัดระบบการจ้างแรงงานต่างด้าว (2549) พบวา่ ประเทศไทยโดยรัฐบาลที่ผานมาหลายสมัยได้มีนโยบาย ่ และพยายามที่จะผลักดันให้หลักประกนดังกล่าวเกิดขึ้นอยู่บ้างโดยเฉพาะกบประชากรบางกลุ ั ่มที่ระบุในรัฐธรรมนูญแห่งราชอาณาจักรไทย แก้ไขเพิ่มเติม(ฉบับที่ 5) พ.ศ. 2538 หมวดที่ 3 วาด้วยสิทธิและเสรีภาพของประชาชนชาติไทย ่ มาตรา 41 ได้บัญญัติไว้ว่า “บุคคลย่อมมีสิทธิได้บริการทางด้านสาธารณสุขที่ได้มาตรฐาน และผู้ยากไร้มีสิทธิได้รับการรักษาพยาบาลโดยมิได้คิดมูลค่า” อันถือเป็นการรับรองสิทธิของบุคคลที่จะได้รับการบริการสาธารณสุข ที่ได้มาตรฐานและรับรองสิทธิของผู้ยากไร้ที่จะได้รับการรักษาพยาบาล โดยมิได้คิดมูลค่า และปรัชญาที่ว่าด้วยความเสมอภาคของการเข้าถึงบริการทางการแพทย์และสาธารณสุข ในกรณีที่แรงงานข้ามชาติได้เข้ามาท างานในประเทศไทยแบบถูกกฎหมาย โดยได้มีการขึ้นทะเบียนแรงงาน ซึ่งทางภาครัฐบาลเริ่มมีการผ่อนผันให้มีแรงงานข้ามชาติที่ลักลอบเข้าเมืองตั้งแต่ปี พ.ศ.2539 ภาคราชการมีมาตรการหลักเพียงอย่างเดียวที่คือการบังคับให้มีการตรวจร่างกายแรงงาน

1) การตรวจสุขภาพประจำปี
2) บริการด้านการรักษาพยาบาล
3) บริการส่งเสริมสุขภาพและป้องกันโรค
4) การเฝ้าระวังโรคและเนื่องจากปัจจุบันมีการปรับเปลี่ยนแนวนโยบายของรัฐบาล ในการสร้างหลักประกนสุขภาพถ้วนหน้าสำหรับ
