การประชุมใหญ่

ข้อ 34. ในการประชุมใหญ่ครั้งใด ถ้าไม่ได้องค์ประชุมตามที่กำหนดไว้ ให้ดำเนินการดังนี้
(1) ถ้าการประชุมใหญ่ครั้งนั้นได้เรียกตามคำร้องขอของสมาชิก ให้งดประชุม
(2) ถ้าการประชุมใหญ่ครั้งนั้นเป็นการประชุมใหญ่ที่สมาชิกมิได้ร้องขอตาม (1) ให้นิติบุคคลหมู่บ้านจัดสรรเรียกประชุมใหญ่อีกครั้งหนึ่ง โดยจัดให้มี ีการประชุมขึ้นภายในสามสิบวัน นับแต่วันที่มีการประชุมใหญ่ครั้งแรก การประชุมครั้งหลังนี้ต้องมีสมาชิกมาประชุมซึ่งมีคะแนนเสียงลงคะแนนรวมกัน ไม่น้อยกว่าหนึ่งในสิบของจำนวนคะแนนเสียงทั้งหมด และมีจำนวนสมาชิกเข้าร่วมประชุมไม่น้อยกว่าสิบคนจึงจะเป็นองค์ประชุม
ข้อ 35. ให้ประธานกรรมการทำหน้าที่ประธานและดำเนินการประชุมใหญ่ ถ้าประธานกรรมการไม่มาประชุมหรือไม่อาจปฏิบัติหน้าที่แทนได้ ให้กรรมการที่มาประชุมเลือกกรรมการ คนหนึ่งเป็นประธานในที่ประชุม
มติของที่ประชุมใหญ่ ให้ถือเอาคะแนนเสียงข้างมากของสมาชิกที่เข้าร่วมประชุม ถ้ามีคะแนนเสียงเท่ากันให้ประธานที่ประชุมใหญ่เป็นผู้ออกเสียง ชี้ขาด
เมื่อที่ประชุมใหญ่ของสมาชิกมีมติเห็นชอบการกำหนดอัตราค่าใช้จ่ายที่คณะกรรมการหมู่บ้านจัดสรรเสนอแล้วในการลงคะแนนเสียง ให้สมาชิกคนหนึ่ง มีคะแนนเสียงเท่ากับอัตราส่วนค่าใช้จ่ายในการบำรุงรักษาและจัดการสาธารณูปโภค ถ้าสมาชิกคนเดียวมีคะแนนเสียงเกินกึ่งหนึ่งของจำนวนคะแนนเสียงทั้งหมด ให้ลดจำนวนคะแนนเสียงของผู้นั้น ลงมาเหลือเท่ากับจำนวนคะแนนเสียงของสมาชิกอื่นรวมกัน ในกรณีที่คะแนนเสียงเท่ากัน ให้นับจำนวนสมาชิกที่ออกเสียงลงคะแนน เป็นเกณฑ์ในการลงคะแนนเสียง
ข้อ 36. สมาชิกอาจมอบฉันทะเป็นหนังสือให้ผู้อื่นเข้าร่วมประชุมและออกเสียงแทนตนได้ แต่ผู้รับมอบฉันทะคนหนึ่งจะรับมอบฉันทะให้ออกเสียง ในการประชุมครั้งหนึ่งได้ไม่เกิน..........ราย

ข้อ 38. ห้ามมิให้นิติบุคคลหมู่บ้านจัดสรรโอนที่ดินอันเป็นสาธารณูปโภคหรือบริการสาธารณะทั้งหมดหรือบางส่วนให้เป็นสาธารณประโยชน์หรือ ให้แก่องค์กรปกครองส่วนท้องถิ่นหรือบุคคลอื่น เว้นแต่ที่ประชุมใหญ่ของสมาชิกนิติบุคคลหมู่บ้านจัดสรรจะมีมติให้ดำเนินการได้ และต้องได้รับอนุญาต จาก คณะกรรมการจัดสรรที่ดินกรุงเทพมหานคร / คณะกรรมการจัดสรรที่ดินจังหวัด.........................
