การร้องทุกข์ให้กระทำได้ด้วยวาจาหรือยื่นเป็นหนังสือต่อเจ้าพนักงาน หรือทำเป็นหนังสือใส่ตู้รับเรื่องราวร้องทุกข์ที่ติดประจำแดนไว้ในแดน

3. ผู้ต้องขังที่คดีเด็ดขาดแล้ว ถ้าศาลพิพากษาจำคุกตลอดชีวิต การสอบเลื่อนชั้น จะถือหมายเด็ดขาดครบ 1 ปี อย่างเดียวเท่านั้น
4. ผู้ต้องขังที่คดีเด็ดขาดแล้ว ถ้าศาลพิพากษาจำคุกมีกำหนดโทษเป็นตัวเลข การสอบเลื่อนชั้นจะถือตามหลักเกณฑ์หมายเด็ดขาด
ครบ 3 เดือน หรือเด็ดขาดไม่ครบ 3 เดือน ก็ต้องมีวันจำคุกมาแล้วไม่น้อยกว่า 6 เดือน (อย่างใดอย่างหนึ่ง)
5. ต้องมีหน่วยงานฝึกวิชาชีพฯ และหัวหน้าหน่วยงานจะต้องรับรองผลการฝึกวิชาชีพ และรับรองความประพฤติ
หรือการศึกษาที่กระทรวงศึกษารับรอง
6. นักโทษที่ถูกลดชั้นไม่ต่ำกว่าชั้นกลาง จะเลื่อนชั้นได้ต้องอยู่ในชั้นเดิมมาไม่น้อยกว่า 6 เดือน
เพิ่มระยะเวลาในการกระทำผิดวินัยอีก 6 เดือน เท่ากับ 1 ปี
7. ผู้ต้องขังที่เป็นนักโทษเด็ดขาด ชั้นเลว ตามมาตรา 92, 93 และ 97 จะเลื่อนชั้นได้ต้องเด็ดขาดมาแล้ว 1 ปี
หรือจำคุกมาแล้ว 1 ปี 6 เดือน (อย่างใดอย่างหนึ่ง)
8. ผู้ต้องขังที่เป็นนักโทษเด็ดขาด ชั้นเลว, ชั้นเลวมาก จะได้รับการพิจารณาเลื่อนชั้นได้ต้องอยู่ในชั้นเดิม 1 ปี
