ในกรณีที่ความเสียหายเกิดจากตัวอุปกรณ์เอง เช่น การเสื่อมสภาพตามเวลา หรือชำรุดเพราะไม่ได้มาตรฐานฯลฯ/ ระบบไฟฟ้า เช่น ไฟตกหรือไฟเกิน หรือไฟฟ้าลัดวงจร ฯลฯ หรือภัยธรรมชาติ ฯลฯ ซึ่งมิได้อยู่ในความควบคุมดูแลของผู้รับจ้าง ผู้ว่าจ้างจะต้องรับผิดชอบต่อความเสียหายเหล่านั้น
