โดยคดีดังกล่าวได้ยื่นฟ้องต่อศาลปกครองพิษณุโลก มาตั้งแต่วันที่ 11 ธันวาคม 2552 หลังจากที่หน่วยงานภาครัฐที่ถูกฟ้องคดีดังกล่าวปล่อยปละละเลย และใช้อำนาจอนุญาตให้มีเหมืองแร่สังกะสี ในบริเวณพื้นที่ต้นน้ำของชาวบ้าน จนทำให้เกิดการแพร่กระจายของสารแคดเมียม กระจายไปในพื้นที่นาข้าวของชาวบ้านใน 3 ตำบล คือ ต.แม่ตาว ต.แม่กุ และ ต.พระธาตุผาแดง อ.แม่สอด จ.ตาก ทำให้ผลผลิตนาข้าวของชาวบ้านปนเปื้อนด้วยสารแคดเมียม จนไม่สามารถทำนาได้ตามปกติ
